Article 1: Administration <br /> Section 1.2: Official Zoning Atlas <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 1-8 <br /> <br />(1) The standards shall be in effect only for the period of time necessary to achieve <br />the purposes of the contemplated plan and/or its implementing mechanisms; <br />(2) The standards shall limit development to the type that would be permitted under <br />the existing standards contained in this Ordinance and/or to that which is in <br />accord with the contemplated plan or its implementing mechanisms; <br />(3) The standards may be in effect only in the area affected by the contemplated <br />plan and/or in which its implementing mechanisms will apply; and <br />(4) The standards may limit the nature and type of development applications and <br />projects which are approved throughout the duration of the standards. <br />SECTION 1.2: OFFICIAL ZONING ATLAS <br />1.2.1 Generally <br />(A) The Orange County planning and zoning jurisdiction shall be, and hereby is, divided into <br />Zoning Districts as detailed in Article 3 of this Ordinance. <br />(B) The boundaries of said Zoning Districts are hereby established as shown on the Official <br />Zoning Atlas which accompanies this Ordinance and which, with all notations, references, <br />and other information shown thereon, shall be as much a part of this Ordinance as it is <br />fully described herein. Maps and descriptions accompanying enacted amendments shall <br />be displayed by the Planning Department adjacent to the Official Zoning Atlas until such <br />time as the official copy is corrected. <br />(C) The Official Zoning Atlas and any subsequent amendments shall be authenticated by the <br />Clerk to the Board of County Commissioners and kept on file in the Planning Department. <br />(D) Copies of the Official Zoning Map Atlas, or portions thereof, may be made from time to <br />time. These copies are for informational purposes only and the Official Zoning Atlas, as <br />described herein, shall be the final and sole authority as to the zoning status of land <br />within the zoning jurisdiction of Orange County. <br />(E) The Planning Director shall be responsible for entering amendments to the Official <br />Zoning Atlas. <br />(F) The Planning Director shall authenticate the entry of each amendment to the Official <br />Zoning Atlas and shall maintain a record of the nature and date of entry of each <br />amendment. <br />(G) Changes to the Official Zoning Atlas, other than those authorized by duly approved <br />amendments to this Ordinance, shall not be made. The making of unauthorized changes <br />to the Official Zoning Atlas shall be considered a violation of this Ordinance. <br />(H) Amendments to this Ordinance that result in the change in classification of any piece of <br />land shall become effective immediately upon enactment by the Board of County <br />Commissioners. The Board of County Commissioners, upon a finding of due cause, may <br />extend the effective date of any such amendments. <br />(I) When all or part of the Official Zoning Atlas becomes damaged, lost, destroyed, worn or <br />hard to interpret by reason of its age, condition, number of changes or otherwise, the <br />Atlas shall be replaced by the Planning Director. This new edition of the Official Zoning <br />Atlas may not change the zoning status of any property. Such replacements shall be <br />authenticated by the Clerk of the Board of County Commissioners and shall bear the date <br />of replacement. <br />1.2.2 Interpretation of Zoning District Boundaries <br />When there is any uncertainty as to the intended location of any zoning district boundary on the <br />Zoning Atlas, the Planning Director shall make an interpretation of the Atlas upon request of any <br />person. Any person aggrieved by any such interpretation may appeal such interpretation to the <br /> 31
