Article 1: Administration <br /> Section 1.1: General Provisions <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 1-2 <br /> <br />(B)(C) Flood Insurance Rate Maps (FIRM), specifically FIRM Map Index 37135 CINDOC with an <br />effective date of May 16, 2008 as well as all FIRM panels contained therein, developed <br />by FEMA under a Cooperating Technical State agreement with the State of North <br />Carolina and the Flood Insurance Study are hereby established as shown on the Official <br />Zoning Atlas as the Special Flood Hazard Area Overlay Zoning District, The Special <br />Flood Hazard Areas (SFHA) are those identified under the Cooperating Technical State <br />(CTS) agreement between the State of North Carolina and FEMA in its FIS dated <br />November 17, 2017 for Orange County and associated DFIRM panels, including any <br />digital data developed as part of the FIS, which are adopted by reference and declared a <br />part of this ordinance. <br />Future revisions to the FIS and DFIRM panels that do not change flood hazard data <br />within the jurisdictional authority of Orange County are also adopted by reference and <br />declared a part of this ordinance. Subsequent Letter of Map Revisions (LOMRs) and/or <br />Physical Map Revisions (PMRs) shall be adopted within 3 months. <br />For reference, previous SFHA data was produced under the Cooperating Technical State <br />agreement between the State of North Carolina and FEMA or Flood Insurance Study <br />(FIS) and its accompanying FIRMs for Orange County dated February 2, 2007, with <br />incorporation of Letters of Map Amendments 07-04-6156R, 08-04-2897A, 08-04-2898A, <br />08-04-2899A, and 08-04-2900A, Letters of Map Revision 06-04-BQ22P, 06-04-C141P, <br />07-04-6156R, and 08-04-1666P and Summary of Map Amendment #115-CWG (C) dated <br />May 16, 2008, which with accompanying supporting data, including Letters of Map <br />Amendment or Revision and Summary of Map Amendments, were adopted by reference <br />and declared to be a part of this Ordinance as part of the Special Flood Hazard Area <br />Overlay District, which was eliminated with the adoption of the November 17, 2017 <br />FIS.5and <br />(D) This ordinance in part comes forward by re-enactment of some of the provisions of the <br />Flood Damage Prevention Ordinance enacted XXXXXX as amended, and it is not the <br />intention to repeal but rather to re-enact and continue to enforce without interruption of <br />such existing provisions, so that all rights and liabilities that have accrued thereunder are <br />reserved and may be enforced. The enactment of this ordinance shall not affect any <br />action, suit or proceeding instituted or pending. All provisions of the Flood Damage <br />Prevention Ordinance of Orange County enacted on XXXXXXXX, as amended, which are <br />not reenacted herein are repealed. <br />(C)(E) The Board of Adjustment as established by Orange County shall hear and decide <br />requests for variances from flood damage prevention regulations as detailed in Section <br />2.10.4 of this Ordinancethe requirements of the Orange County Special Flood Hazard <br />Area Overlay Zoning District.6 <br />1.1.4 Purpose and Intent <br />(A) In order to protect and promote the health, safety and general welfare of the County and <br />its residents, this Ordinance is hereby adopted by the Orange County Board of <br />Commissioners. <br />(B) The purpose of the regulations set out in this Ordinance shall be to accomplish <br />compatible development of the land within Orange County in a manner which will best <br />promote the health, safety, and general welfare, as well as to: <br />(1) Provide for efficiency and economy in the process of development; <br /> <br />5 The blue underlined text was originally located in Section 4.3.5 of the UDO as part of the Special Flood Hazard <br />Area overlay district. Red underlined text is new text proposed to reference past FIS studies, which served as the <br />basis for the overlay district now deleted as part of this process. <br />6 Staff is recommending the deletion of the Special Flood Hazard Area Overlay District.
