Article 7: Subdivisions <br /> Section 7.12: Flexible Developments <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 7-37 <br /> <br />(B) Allowed water supply and wastewater treatment systems are available for residential <br />service, and each lot is served by separate water supply and sanitary sewage <br />connections. <br />(C) The total number of lots proposed for the tract, excluding parcels of reserved Common <br />Open Space, is not greater than the number determined by dividing the gross land area <br />(excluding public and private road rights-of -way) by the minimum lot size required for the <br />Rural Buffer zoning district and Watershed Protection Overlay District requirements for <br />University Lake Watershed, if applicable. <br />(D) The Common Open Space reserved within the tract conforms to Section 7.11. <br />(E) Common Open Space shall not include areas devoted to public or private vehicular <br />streets. <br />7.12.4 Common Open Space Standards <br />(A) Minimum Required Common Open Space <br />(1) Where a subdivider elects to seek approval of a Major Subdivision utilizing the <br />Flexible Development Option as specified herein, at least 33% of the total land <br />area in the Flexible Development must be set aside as protected Common Open <br />Space. <br />(2) Where a subdivider elects to seek approval of a Minor Subdivision utilizing the <br />Flexible Development Option as specified herein, the development shall provide <br />at least: <br />(a) 33-39% of the total land area in Common Open Space areas for <br />subdivisions with a minimum residential lot size of 43,560 square feet; <br />(b) 40-44% of the total land area in Common Open Space areas for <br />subdivisions with a minimum residential lot size of 30,000 square feet; <br />(c) 5045-49% of the total land area in Common Open Space areas for <br />subdivisions with a minimum residential lot size of 20,000 square feet; <br />OR <br />(d) 6050-59% of the total land area in Common Open Space areas for <br />subdivisions with a minimum residential lot size of 15,000 square feet.; <br />and <br />(e) 60% or more of the toal land area in Common Open Space areas <br />for subdivisions with a minimum residential lot size of 10,000 <br />square feet. <br />(3) Such Common Open Space shall meet the standards contained in this Section <br />unless the subdivider chooses to seek approval of a conventional subdivision as <br />specified herein. <br />(B) Planning for Common Open Space <br />(1) Common Open Space design in subdivision projects shall be planned as part of <br />a comprehensive pr oject design. <br />(2) The long-term success of open space is improved when a layout is chosen with a <br />perspective of future usefulness, efficiency, connectivity and compatibility with <br />both existing development and other types of open spaces. <br />(3) Common Open Space is an important amenity for subdivision residents and an <br />essential part of the County’s character and environmental quality. <br />(4) Common Open Space planning must indicate a thoughtful understanding of that <br />importance, and shall be evaluated based on its merits. <br /> 42
