Article 5: Uses <br /> Section 5.6: Standards for Commercial SERVICE Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-49 <br /> <br />(e) A temporary custodial care unit shall be required to connect to water, <br />wastewater, and electric utilities serving the principal structure on the <br />property. <br />(f) The Orange County Health Department, or the agency that provides <br />sanitary sewer and water services, shall approve water and wastewater <br />disposal facilities. <br />(g) All applicable state and local approvals and permits shall be procured <br />including, but not limited to, a zoning compliance permit, building <br />permits, and health department approval. <br />(h) Approval of the application shall not exceed one year. Annual renewal <br />shall require a new application and recertification from a licensed <br />physician stating the necessity of direct care. <br />(i) Any approved temporary custodial care unit shall be removed no later <br />than 180 days after the time the mentally or physically impaired <br />person(s) is no longer receiving care or is in need of assistance. If the <br />structure is needed for a different impaired person, the temporary <br />custodial care unit may continue to be used, subject to the requirements <br />of this Ordinance. <br />(j) The caregiver shall allow inspections of the property by the County at <br />times convenient to the caregiver, during reasonable hours, and upon <br />prior notice for compliance purposes. <br />(k) A permit for a temporary custodial care unit may be revoked by the <br />Planning Director due to failure of the applicant to comply with any of the <br />above provisions. <br />5.5.10 Multi-Family <br />(A) Standards for EDH-3 and EDH-4 Zoning Districts <br />(1) Multi-family uses are permitted in the EDH-3 and EDH-4 zoning districts only in <br />accordance with the following standards: <br />(a) The site plan must identify the square footage of each building by type of <br />use. <br />(b) A permitted Principal Use must be established on at least 50% of the <br />total square footage of structures on the site. <br />(c) Multi-family dwellings shall not exceed 25% of the total square footage of <br />all structures on the site. <br />SECTION 5.6: STANDARDS FOR COMMERCIAL SERVICE USES <br />5.6.1 Cemetery <br />(A) General Standards for all Cemetery uses: <br />(1) No internments9 shall take place within 30 feet of any lot property line.10 <br />5.6.1(B) Standards for Family Cemeteries11 <br /> <br />9 Correcting existing spelling error. <br />10 An existing standard we are recommending be applied to all internments regardless of their location (i.e. <br />commercial, family, religious facility, etc.) <br />11 Staff is recommending creating a distinction for family cemeteries from commercial cemeteries to ensure we are <br />not creating unnecessary impediments on the establishment of same. Staff is also recommending establishing <br />reasonable regulation(s) to ensure the cemetery is properly denoted on the parcel and perpetual access <br />rights/maintenance responsibilities are established in the event the property is sold. <br /> 126
