STAFF COMMENT: Staff had reviewed numerous options to incorporate additional <br />land uses/categories including utilizing the North American Industry Classification <br />System (NAICS), currently used within Section 5.2.2 Table of Permitted Uses – <br />Economic Development Districts, and the Land Based Classification Standards <br />(LBCS) as prepared by the American Planning Association (APA) frameworks. <br />After additional review with the County’s Attorney office, staff has proceeded with <br />utilizing the existing format/land use categories contained within Section 5.2.2. While <br />we will still need to modify this list to ensure compliance with the Byrd decision, the <br />existing format is sufficient to address our needs. <br />2. General discussion on the continued need for certain general use zoning districts. <br />STAFF COMMENT: There was general discussion on the possible elimination of <br />several existing Economic Development – Hillsborough districts, relying on the <br />existing framework utilized with the Buckhorn and Eno Economic Development <br />districts (i.e. low and high intensity). No course of action has been recommended at <br />this time. <br />As a reminder this was for discussion purposes only and was being used as a means <br />of ascertaining the need for future ordinance modifications. <br />Based on previously comments/recommendations, staff has completed the following: <br />a. Attachment 2 contains the existing table of permitted uses list(s) with footnotes <br />indicating where existing land uses are proposed for relocation. <br />b. Attachment 3 contains the proposed table of permitted uses list. This incorporates <br />existing land use categories contained in Section 5.2.2 of the UDO and expands <br />the list of both permitted and prohibited land uses. <br />This item is currently going through staff peer review, which will take most of the month. <br /> <br />FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding <br />for the provision of County services. Existing staff, included in the Departmental staffing budget, <br />will accomplish the work required to process this amendment. <br /> <br />RECOMMENDATION(S): Planning staff recommends the Ordinance Review Committee review <br />and comment upon the proposed amendments to the UDO. <br /> <br /> <br /> <br /> <br /> 3
