Article 7: Subdivisions <br /> Section 7.12: Flexible Developments <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 7-40 <br /> <br />7.12.3 Criteria in the Rural Buffer (RB) Zoning District24 <br />Flexible developments may be approved in the Rural Buffer zoning district upon the following <br />findings: <br />(A) The tract is a minimum of 400,000 square feet. <br />(B) Approved water supply and wastewater treatment systems are available and each lot is <br />served by separate water supply and sanitary sewage connections. <br />(C) The total number of lots proposed for the tract, excluding parcels of reserved Common <br />Open Space, is not greater than the number determined by dividing the gross land area <br />(excluding public and private road rights-of-way) by the minimum lot size required for the <br />Rural Buffer zoning district and Watershed Protection Overlay District requirements for <br />University Lake Watershed, if applicable. <br />(D) The Common Open Space reserved within the tract conforms to Section 7.11. <br />(E) The minimum amount of land reserved as Common Open Space shall be the sum of all <br />reductions in minimum lot area as a result of the flexible form of development and/or the <br />minimum Common Open Space required in Section 7.11, whichever is greater. <br />(F) Flexible Common Open Space shall not include areas devoted to public or private <br />vehicular streets. <br />(D) Flexible developments in the UNIV-PW and UNIV-CA Watershed Protection Overlay <br />Districts shall comply with the development standards as set forth in Section 4.2 of this <br />Ordinance.25 <br />7.13.37.12.4 Common Open Space Standards <br />(A) Minimum Required Common Open Space <br />(1) Where a developer subdivider elects to seek approval of a Major Subdivision <br />utilizing the Flexible Development Option as specified herein, at least 33% of the <br />total land area in the Flexible Development must be set aside as protected <br />Common Open Spaceopen space. <br />(2) Where a subdivider elects to seek approval of a Minor Subdivision utilizing the <br />Flexible Development Option as specified herein, the development shall provide <br />at least: <br />(a) 33% of the total land area in Common Open Space areas for <br />subdivisions maintaining a minimum residential lot size of 43,560 <br />square feet; <br />(b) 40% of the total land area in Common Open Space areas for <br />subdivisions maintaining a minimum residential lot size of 30,000 <br />square feet; <br />(c) 45% of the total land area in Common Open Space areas for <br />subdivisions maintaining a minimum residential lot size of 20,000 square <br />feet; OR <br />(d) 50% of the total land area in Common Open Space areas for <br />subdivisions maintaining a minimum residential lot size of 15,000 square <br />feet. <br /> <br />24 Original language from Section 7.12.2 Cluster Developments of the UDO updated to use the term “Flexible”  <br />rather than “Cluster”.  For more information please refer to Footnote number 23.  <br />25 Language is unnecessary given wording in Section 7.12.2 (E) of the proposed amendment.  <br /> 73
