Article 7: Subdivisions <br /> Section 7.4: Improvements and Performance Guarantees <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 7-4 <br /> <br />any applicable federal, state, or county standards to include, but not be limited to, the <br />following: <br />(1) All roads within the subdivision and improvements to existing roads required for <br />safe and adequate access to the subdivision; <br />(2) Road signs; <br />(3) Water supply and wastewater systems, other than individual wells and septic <br />tanks; <br />(4) Drainage facilities and easements; <br />(5) Stormwater management devices; <br />(6) Erosion and sedimentation control devices; <br />(7) Low-impact (passive) and active recreation amenities; <br />(8) Fire suppression management facilities; <br />(9) Common Open sSpace, Rrecreation or Llandscape management improvements, <br />areas, and facilities; and13 <br />(10) Any other on- or off-site improvements required by this Ordinance or required at <br />the time of preliminary plat approval. <br />(B) If the subdivider records a plat for only a portion of the subdivision for which a preliminary <br />plat was approved, the improvements required to be constructed, installed, and <br />maintained in accordance with said recorded plat shall be those improvements that the <br />Planning Director deems necessary to serve the lots shown on the recorded plat. <br />7.4.3 Completion of Improvements <br />(A) The Planning Director shall not approve a final plat presented for recordation until: <br />(1) All required improvements have been completed, <br />(2) All required Common Open Space is identified for dedication, construction (if <br />applicable), perpetual maintenance, and legal right of access, or <br />(3) A performance guarantee has been provided in accordance with the provisions <br />detailed herein.14 <br />(B) An improvement shall be deemed completed only after the appropriate public agency has <br />certified that the improvement(s) has been installed in accordance with the approved <br />preliminary plat, the approved construction plan, and in accordance with applicable <br />federal, state, and county regulations. <br />(C) In lieu of certification from a public agency, the Planning Director is authorized to accept <br />certification from the applicant’s licensed professional engineer or licensed professional <br />surveyor or other professional as authorized by the North Carolina General Statutes that <br />the improvements have been installed in accordance with all applicable standards. <br /> <br />13 Staff is adding language clarifying those areas subject to maintenance responsibility.  We are clarifying the type  <br />of open space subject to maintenance, for example, as primary/secondary open space is not intended for  <br />disturbance or maintenance by anyone.  It is supposed to be left alone.  The revised language eliminates a  <br />contradiction and properly identifies what is required to be maintained.  <br /> 50
