Article 5: Uses <br /> Section 5.17: Standards for Miscellaneous Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-141 <br /> <br />(l) Type of runway proposed, specifically precision versus non-precision <br />instrument runways. <br />(m) Evidence the proposed airport complies with applicable Federal Aviation <br />Administration (FAA) and State regulations. <br />(3) Standards of Evaluation <br />(a) No structure greater than 50 feet in height shall be erected, altered or <br />maintained, and no trees shall be allowed to grow in any Airport Surface <br />Zone created under the AP-CZ district.15 <br />(b) A perimeter land use buffer shall be installed or maintained consistent <br />with the Type E land use buffer standard as detailed in Secton 6.8.6 of <br />this Ordinance.16 <br />(c) A facility with an non-precision instrument runway shall be allowed to <br />operate only from dawn to dusk. <br /> <br />5.17.6 Major Subdivision <br />(A) Standards for Class A Special Use Permit <br />(1) Submittal Requirements <br />In addition to the information required in Section 2.7, the following shall be <br />submitted as part of the application: <br />(a) Notification <br />Stamped envelopes addressed to each owner of property within 500 feet <br />of the property proposed for subdivision. The names and addresses of <br />property owners shall be based on the current listing as shown in the <br />Orange County Land Records system. <br />(b) Development Schedule <br />A statement, from the applicant, indicating the anticipated development <br />schedule for the build out of the project. <br />(c) Water and Wastewater <br />(i) If the proposed lots are to be served by a public water system, <br />proof of water supply and service availability in the form of a <br />certified copy of a resolution to that effect enacted by the <br />governing body of the water system providing the water to serve <br />the lots in the subdivision. <br />(ii) If the proposed lots are to be served by a public sewer system <br />proof of public sewer service availability in the form of a certified <br />copy of a resolution to that effect enacted by the governing body <br />of the sewer system providing the sewer service to the lots in the <br />subdivision. <br /> <br />15 In reviewing other example Ordinances height limits can range from 50 to 75 feet. Staff selected 50 feet as it is <br />more consistent with existing height limits in other general use zoning districts. <br />16 In recommending this standard staff understands there will be concerns over potential conflicts created with the <br />preservation/planting of vegetation and aircraft safety (i.e. approach and take off patterns). Our goal is to require <br />a sufficient land use buffer to shield adjacent property owners from the impacts of an Airport – General Aviation <br />facility and confine runaway areas to the interior portion of the AP‐CZ District in an attempt to mitigate noise, <br />vibration, and visual impacts. <br /> 67
