Article 5: Uses <br /> Section 5.17: Standards for Miscellaneous Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-138 <br /> <br />(b)(c) The site and its operation will not adversely affect existing adjacent land <br />uses. <br />(c)(d) Land sufficient to provide approach zones and overrun areas is owned or <br />controlled by the applicant. <br />(d)(e) Adequate land area is provided for all of the proposed uses, buildings <br />and storage areas. <br />(e)(f) Screening of buildings, storage and maintenance areas is provided from <br />adjacent residential land. <br />(f)(g) Letters from appropriate fire and rescue agencies that protective services <br />can be provided at an adequate level. <br />(g)(h) Access shall be directly onto a State maintained road. <br />(h)(i) Compatible land uses are located in the final approach areas of the <br />airport. <br />(C) Standards for Airports – General Aviation (AP-CZ) <br />(1) Pre-application Submittal Requirements12 <br />(a) Letter of Intent: An applicant shall be required to submit to the Planning <br />Department a Letter of Intent indicating the interest in developing an AP- <br />CZ District within the county. As part of this Letter, the applicant shall <br />include the following: <br />(i) A map and aerial photo of the subject property including a legal <br />description, <br />(ii) Preliminary feasibility studies outlining the rationale for choosing <br />the site in question, <br />(iii) A site plan outlining the location of all facilities and required <br />areas as detailed herein, and <br />(iv) An environmental assessment completed in accordance with <br />Section 6.16.3 of the Ordinance. <br />Staff shall inform the County Manager’s office in writing within 5 days of <br />the submittal of the letter and outline a preliminary schedule for review of <br />the project. <br />(b) Initial Neighborhood Information Meeting: Within fourteen days of <br />submitting the Letter of Intent the petitioner shall schedule, at their <br />expense, a Neighborhood Information Meeting (NIM) designed to inform <br />local residents of the proposed project. The location of this meeting shall <br />be a government office, community building, or other similar facility that <br />is located in close proximity to the proposed District. <br />During this meeting, Planning Staff will outline the process that will be <br />employed to review the formal application, once submitted, and outline <br />the detailed studies and plans that will be part of the review process. <br />The applicant shall adhere to notification criteria outlined within Section <br />2.9.2 (D) of this Ordinance. <br /> <br />12 Given the nature of the development staff believes it would be appropriate to require a the submittal of a notice <br />of intent to inform all parties of a pending application as well as an initial neighborhood meeting so that the <br />general public can comment on the proposed prior to it being submitted. As written there will be 2 neighborhood <br />meetings for the development of an Airport‐ General Aviation facility with the second meeting occurring prior to <br />the actual public hearing. <br /> 64
