license for engaging in any sexually oriented business that <br />has been suspended or revoked anywhere. <br /> <br />(e) The issuance of the license prescribed herein shall not convey onto the <br />applicant the ability to commence operations until all applicable <br />permits (i.e. Health Department Permit, Zoning Compliance Permit, <br />Certificate of Occupancy, etc.) have been issued. <br />(f) If the Sheriff’s office has not approved or denied the sexually oriented <br />business license application within thirty (30) days from receiving the <br />completed assessments from applicable review agencies, the license <br />shall be deemed granted. <br /> <br />Section 8-105 Inspection of a sexually oriented business. <br /> <br />An applicant or licensee shall permit representatives of the Sheriff’s <br />Department, Emergency Services, the Orange County Planning and <br />Inspections Department, the Orange County Health Department, or any <br />other county, state, or federal department, division, or agency that enforces <br />codes, regulations, ordinances, or statutes relating to human health, safety, <br />or welfare to inspect the premises of any sexually oriented business for the <br />purpose of insuring compliance with the law, at any time it is occupied or <br />open for business. Failure or refusal by any person to permit a lawful <br />inspection of the premises during regular business hours shall be <br />punishable in accordance with County code and, in addition, may result in <br />the revocation of the license. <br /> <br />Section 8-106 Denial or revocation of license. <br /> <br />(a) Before the County revokes a license issued pursuant to this article, or <br />determines reasonable grounds exist to deny an application for a <br />license pursuant to this article, the Sheriff’s Office shall cause a <br />written notice to be sent by certified mail to the licensee or applicant <br />affected, at the address stated in the license or application. <br /> <br />(b) A license issued pursuant to this section shall be revoked if the <br />Sheriff’s office determines that: <br /> <br /> (1) The licensee has violated any provision of this article; <br /> <br /> (2) The licensee, or the legal or beneficial owner of any interest in <br />the licensee is convicted of any felony; prostitution or any <br />violation of any law relative to prostitution; crime involving <br />sexual misconduct; as codified in the laws of the United States, <br />this or any other state, including, but not limited to convictions <br />of violations of any of the offenses enumerated in Articles 26, <br />20
