That Chapter 8 Business of the Orange County Code of Ordinances be amended by <br />adding a new Article IV Sexually Oriented Businesses reading as follows: <br /> <br />Article IV. SEXUALLY ORIENTED BUSINESSES <br /> <br />Section 8-100 Scope. <br /> <br />(a) Orange County is committed to protecting the general welfare of <br />residents, property owners, and visitors through the enforcement of <br />laws prohibiting obscenity, indecency, and sexual offenses. The <br />purpose of this article is to establish a licensing provision for sexually <br />oriented businesses to reduce and eliminate their deleterious effects <br />while preserving constitutionally protected forms of expression by <br />establishing reasonable and uniform regulations. The provisions of this <br />article have neither the purpose nor effect of imposing a limitation or <br />restriction on the content of any communicative materials, restricting <br />or denying access by adults to materials protected by the First <br />Amendment, or denying access by the distributors and exhibitors of <br />sexually oriented entertainment to their intended market. Further, the <br />provisions of this article have neither the intent nor effect of condoning <br />or legitimizing the distribution of obscene material. <br /> <br />In allowing these uses, the County balances its constitutional <br />obligations with the need to guarantee our local economy and quality <br />of life is not impeded. <br /> <br />Section 8-102 Definition of Terms <br /> <br />The definition of specific terms shall be consistent with those detailed <br />within Article 10 of the County Unified Development Ordinance (UDO). <br /> <br />Section 8-103 Licensing of sexually oriented businesses. <br /> <br />(a) It shall be unlawful for any person, group of people, or corporation to <br />operate a sexually oriented business without a valid sexually oriented <br />business license approved by the County pursuant to this Ordinance. <br /> <br />(b) Every application for a sexually oriented business license prescribed <br />herein shall be upon a form approved by the County and shall be filed <br />with the Orange County Sheriff’s office and contain the following <br />information: <br /> <br /> (1) The applicant’s name, including any aliases or other names by <br />which the applicant is known or has used; current physical <br />address of the applicant’s residence; contact telephone <br />Attachment 2 17
