(B) Interested persons may address the Planning Board at the Planning Board’s meeting and <br />public comments may be taken into consideration by the Planning Board in making its <br />recommendation. <br />(C) The Planning Board’s action on an application shall be one of the following: <br />(1) Make no recommendation, <br />(2) Recommend approval, <br />(3) Recommend denial, <br />(4) Recommend approval but with specified changes, or <br />(5) Make a preliminary recommendation, of either (1) through (4) above, with a <br />request to the Board of County Commissioners that if significant new information <br />is presented at the public hearing, the Board of County Commissioners refer an <br />application back to the Planning Board for further review and a potential new <br />recommendation. <br />(a) The Board of County Commissioners is not bound to referring an <br />application back to the Planning Board. <br />2.8.9 Action by Board of County Commissioners <br />(A) The Board of County Commissioners shall not consider enactment of the a proposed <br />amendment until the Planning Board either makes its recommendation or takes no action <br />on the application as prescribed in Section 2.8.8(C). <br />(B) In making its decision, the Board of Commissioners shall consider all relevant evidence <br />presented at the public hearing and any submitted written evidence that was considered <br />by the Planning Board in making its recommendation. <br />(C) The Board of County Commissioners shall not consider enactment of a proposed <br />amendment until after the required public hearing has been held. At the conclusion of the <br />public hearing, the Board of County Commissioners may do one of the following: <br />(1) Continue the public hearing to a date/time certain, <br />(2) Close the public hearing and refer the application back to the Planning Board for <br />further review, <br />(3) Close the public hearing and defer a decision to a later Board of County <br />Commissioners meeting date, or <br />(4) Close the public hearing and make a decision. <br />(D) In making its decision, the Board of Commissioners shall consider comments made at the <br />public hearing, the Planning Board’s recommendation, and the Planning Director’s <br />recommendation. <br />(E) The Board of County Commissioners is not bound by comments and recommendations <br />and may make a decision different from comments and/or recommendations it receives. <br />2.8.10 Text Revisions Pertaining to Soil Erosion and Sedimentation Control Provisions <br />(A) The Erosion Control Officer shall review all of the North Carolina Sedimentation Control <br />Commission’s revisions to the State’s Model Soil Erosions and Sedimentation Control <br />Ordinance and, within 90 days of receipt of the recommended revisions, submit draft <br />amendments to the North Carolina Sedimentation Control Commission for its <br />consideration and comments. <br />(B) Within 150 days after receipt of the North Carolina Sedimentation Control Commission’s <br />comments, Orange County shall formally consider proposed amendments and, to the <br />extent deemed necessary by the Board of County Commissioners, incorporate the <br />amendments into this Ordinance. <br />45
