Article 10: Definitions Section 10.1: Definitions Orange County, North Carolina – Unified Development Ordinance Page 10-51 Telecommunication Facilities, Building Code The most recently adopted or amended edition of the North Carolina State Building Code. Telecommunication Facilities, Building permit An official Orange County administrative authorization to begin construction consistent with the provisions of N.C.G.S. 153A-357. Telecommunication Facilities, Collocation The installation of new wireless facilities on previously approved structures, including wireless support structures, buildings, utility poles, and water tanks. The placement or installation of wireless facilities on existing structures, including electrical transmission towers, water towers, buildings, and other structures capable of structurally supporting the attachment of wireless facilities in compliance with applicable codes. 7 Telecommunication Facilities, Commercial Impracticability or Commercially Impracticable The inability to perform an act on terms that are reasonable in commerce, the cause or occurrence of which could not have been reasonably anticipated or foreseen and that jeopardizes the financial efficacy of the project. The inability to achieve a particular financial return on investment or profit, standing alone, and for a single site, shall not deem a situation to be commercially impracticable and shall not render an act or the terms of an agreement commercially impractical.
