Article 10: Definitions <br /> Section 10.1: Definitions <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 10-51 <br /> <br />Telecommunication Facilities, Building Code <br />The most recently adopted or amended edition of the North Carolina State Building Code. <br />Telecommunication Facilities, Building permit <br />An official Orange County administrative authorization to begin construction consistent with the provisions <br />of N.C.G.S. 153A-357. <br />Telecommunication Facilities, Collocation <br />The installation of new wireless facilities on previously approved structures, including wireless support <br />structures, buildings, utility poles, and water tanks. The placement or installation of wireless facilities on <br />existing structures, including electrical transmission towers, water towers, buildings, and other structures <br />capable of structurally supporting the attachment of wireless facilities in compliance with applicable <br />codes. 7 <br />Telecommunication Facilities, Commercial Impracticability or Commercially <br />Impracticable <br />The inability to perform an act on terms that are reasonable in commerce, the cause or occurrence of <br />which could not have been reasonably anticipated or foreseen and that jeopardizes the financial efficacy <br />of the project. The inability to achieve a particular financial return on investment or profit, standing alone, <br />and for a single site, shall not deem a situation to be commercially impracticable and shall not render an <br />act or the terms of an agreement commercially impractical. <br />Telecommunication Facilities, Equipment Compound <br />An area surrounding or near the base of a wireless support structure within which a wireless facility is <br />located.8 <br />Telecommunication Facilities, EIA-222 <br />Electronics Industries Association Standard 222 (Structural Standards for Steel Antenna Wireless support <br />structures and Antenna Support Structures). <br />Telecommunication Facilities, Equipment enclosure <br />An enclosed structure, cabinet, or shelter used to contain radio or other equipment necessary for the <br />transmission or reception of wireless communication signals. <br /> <br />Telecommunication Facilities, Eligible Facilities Request <br />A request for modification of an existing wireless tower or base station that involves collocation of new <br />transmission equipment or replacement of transmission equipment but does not include a substantial <br />modification.9 <br />Telecommunication Facilities, Existing Structure/Building <br />For purposes of this Section, any building or structure that currently exist on a parcel of land. Such <br />structures may include, but shall not be limited to, telecommunications wireless support structures, <br />overhead transmission line support structures, water tanks, silos, churches, schools, and utility poles. <br />Telecommunication Facilities, Extraordinary Conditions <br />Conditions subsequent to a hurricane, flood, tornado, or other natural or other disaster. <br />Telecommunication Facilities, FAA <br />The Federal Aviation Administration or its duly designated and authorized successor agency. <br /> <br />7 Our existing definition has, which was taken from State law, has been modified to comply with recent changes <br />adopted as part of the 2013-185 Session Law. <br />8 Adding a new definition detailed within the Session Law. <br />9 Adding a new definition detailed within the Session Law.
