Article 10: Definitions <br /> Section 10.1: Definitions <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 10-50 <br /> <br />Subdivision, Minor <br />A division of a tract of land that does not: <br />a) Create more than five lots, including the residual acreage, from any one tract of land in any 24 <br />month period; <br />b) Dedicate or improve any new public street other than widening an existing public street; <br />c) Extend public water and/or sanitary sewerage systems other than laterals to serve individual lots; <br />d) Necessitate the installation of drainage improvements which would require easements through <br />one or more lots to serve other lots; and <br />e) At the option of the applicant, involve vesting of the subdivision for a period greater than one <br />year. <br />Substantial damage <br />Damage of any origin sustained by a structure during any one year period whereby the cost of restoring <br />the structure to its before-damaged condition would equal or exceed 50% of the market value of the <br />structure before the damage occurred. See definition of “substantial improvement.” Substantial damage <br />also means flood-related damage sustained by a structure on two separate occasions during a ten-year <br />period for which the cost of repairs at the time of each such flood event, on the average, equals or <br />exceeds 25% of the market value of the structure before the damage occurred. <br />Substantial improvement <br />Any combination of repairs, reconstruction, rehabilitation, addition, or other improvement of a structure, <br />taking place during any one year period whereby the cost of which equals or exceeds 50% of the market <br />value of the structure before the start of construction of the improvement. This term includes structures, <br />which have incurred substantial damage, regardless of the actual repair work performed. The term does <br />not, however, include either any correction of existing violations of State or Orange County health, <br />sanitary, or safety code specifications which have been identified by the Orange County code <br />enforcement official and which are the minimum necessary to assure safe living conditions, or any <br />alteration of a historic structure provided that the alteration will not preclude the structure's continued <br />designation as a historic structure. <br />Support System <br />A combination of footers, piers, caps, and shims that will, when properly installed, support the mobile <br />home. Masonry walls may be installed as a cosmetic feature. <br />Telecommunication Facilities, Accessory Use <br />A use incidental to, subordinate to, and subservient to the principal use of the property. As defined in this <br />section an accessory use is a secondary use. <br />Telecommunication Facilities, Antenna <br />A system of electrical conductor communications equipment that transmits and/or receives <br />electromagnetic radio signals used in the provision of all types of wireless communications services. <br />Telecommunication Facilities, Applicant <br />Any wireless service provider or wireless support structure owner submitting an application for a wireless <br />facility. <br />Telecommunication Facilities, Application <br />A formal request, containing all necessary and required documentation, submitted to Orange County to <br />construct or modify a wireless support structure or a wireless facility. <br />Telecommunication Facilities, Base Station <br />A station at a specific site authorized to communication with mobile stations, generally consisting of radio <br />receivers, antennas, coaxial cables, power supplies, and other associated electronics.6 <br /> <br />6 The term base station is new to State Law and we are adding the definition to the UDO. <br />43
