NOTICE OF MEETING <br />BOARD OF ADJUSTMENT <br />OF <br />ORANGE COUNTY, NORTH CAROLINA <br />Pursuant to the requirements of the General Statutes of North Carolina, Chapter 153A, <br />Sections 340 and 345.1, Chapter 160A Section 388, and Section 2.11 of the Orange County <br />Unified Development Ordinance (UDO), notice is hereby giventhat the Board of Adjustment will <br />hold a hearingat 300 West Tryon Street (Whitted Building) Hillsborough, NC 27278on Monday <br />July 9, 2018at 7:00PM for the purpose taking specific action on the following item(s): <br />1. A-4-18– PUBLIC HEARING to review a Variance application from Section 3.7 <br />Economic Development Districts – Economic Development Eno Low <br />Intensity (EDE-1) general use zoning district for a parcel of property located <br />at 4916 Old Hillsborough Road (PIN: 0803-30-4715) within the Eno Township. <br />In accordance with the provisions of Section 2.10 of the Orange County Unified <br />DevelopmentOrdinance (UDO) the applicants, Stone and Church Investments <br />LLC, have applied for a VARIANCE from side yard setback standards of the EDE- <br />1 general use zoning district.Specifically the applicant is requesting a 15 ft. <br />reduction in the 25 ft. required side yard setback for a parcel of property at 4916 <br />Old Hillsborough Road. <br />The applicant received site plan approval allowing for further development of the <br />subject parcelthat complied with the required 25 ft. side yard setback. The <br />approved plan proposedthe use of an adjacent private roadwayto serve the <br />project’s vehicular access needs. At the time of site plan approval the owner of <br />the private roadway had consented, in principal, to its use by the applicant’s. <br />The applicant was recently informed use of the private access roadway was no <br />longer going to be permittedby the owner. The applicant argues the setback <br />reduction is necessary to accommodate traffic accessing the propertyand <br />maintain compliance with applicable County and State building code standards. <br />If approved the side yard setback for the proposed structure would be 10 ft. <br />2. A-3-18– Receipt of Subpoenaed documentation for a parcel of property <br />located at the intersection of Morrow Mill and Millikan Roads (PIN: 9729-50- <br />7168). <br />In accordance with action taken at its May 7, 2018 meeting, the Board of <br />Adjustment shall receive subpoenaed material associated with the review of an <br />appeal application concerning the status of a structure located ona parcel of <br />property, identified utilizing Orange County Parcel Identification Number (PIN) <br />9729-50-7168, owned by Southeast Property Group LLC(a.k.a. Wild Flora Farm) <br />care off Ms. Kara Brewer. <br />The Board of Adjustment is scheduled to receive subpoenaed materials. <br />The Board of Adjustment is scheduled to continue the hearing at its August 13, <br />2018 regular meeting <br />As part of the County’s continuing education initiative, the Board shall hold a training session <br />with staff and the County’s Attorney office between 6:00 p.m. and 7:00 p.m. prior to the <br />commencement of the aforementioned public hearing.
