GLEDHILL <br />E -MAIL: geoffrcygledhill @cgandh.com <br />This letter provides my analysis of the legal issues <br />pertinent to.the Orange County staff-recommendation to implement <br />Waste Reduction, Reuse and Recycling Fees ( "WRRR fees "). In a <br />letter dated February 7, 2003, a copy of which is enclosed with <br />this letter, I discussed how the Agreement for Solid Waste <br />Management among Orange County, Carrboro, Chapel Hill and <br />Hillsborough ( "Agreement ") addresses other fees. It is my view <br />that the WRRR fees recommended by the staff are "other fees" as <br />discussed in the Agreement. They therefore may be created or <br />changed by the County by giving the other parties*to the <br />Agreement 30 days notice of the fee or the proposed fee change. <br />If the Solid Waste Advisory Board recommends the change be <br />approved, then the change can take effect if the County <br />subsequently approves it. On the other hand, if the Solid Waste <br />Advisory Board recommends that the fee or fee change not be <br />approved then the change may take effect only if the County and <br />at least one other party to the - Agreement approves the fee or <br />fee change. <br />
