opportunity to achieve the same goals that would be accomplished <br />under a capacity use designation by voluntary compliance with a <br />water management plan; and <br />WHEREAS, the EMC, in its Resolution No. 88 -13, dated <br />September 8, 1988, accepted the Eno River Capacity Use <br />Investigation Hearing Officer's Report, made upon consideration of <br />the recommendation of the North Carolina Department of Natural <br />Resources and Community Development; and <br />WHEREAS, the Eno River reservoir owners and water users <br />expressed willingness to follow the proposed Water Management Plan <br />for the Eno River; and <br />WHEREAS, the EMC endorsed the Water' Management Plan <br />recommended by the Department and by the Hearing Officer and <br />directed the Division of Water Resources to monitor compliance and <br />make periodic reports to the EMC; and <br />WHEREAS, the parties to this agreement are either major water <br />users or otherwise have an important role in the Water Management <br />Plan; and <br />WHEREAS, a failure on the part of the water users and <br />reservoir owners to comply with the Water Management Plan will <br />likely result in the designation by the EMC of the upper Eno River <br />watershed as a capacity use area and subsequent loss of local <br />control. <br />NOW, THEREFORE, the parties agree to the following specific <br />Obligations and responsibilities: <br />1.
