NORTH CAROLINA <br />ORANGE COUNTY <br />ENO RIVER WATER MANAGEMENT PLAN <br />IMPLEMENTATION AGREEMENT <br />THIS MANAGEMENT AGREEMENT <br />entered <br />into this <br />the <br />day <br />of , 1988 among <br />Orange <br />County, <br />North <br />Carolina <br />(hereinafter "County), the Town of Hillsborough, North Carolina <br />(hereinafter "Hillsborough "), Orange - Alamance Water System, Inc. <br />(hereinafter "Orange- Alamance "), and Piedmont Minerals, Inc. <br />(hereinafter "Piedmont Minerals ") for the purpose of implementing <br />the Eno River Water Management Plan: <br />WI T N E S S E T H: <br />WHEREAS, the North Carolina Department of Natural Resources <br />and Community Development, after a capacity use investigation, <br />recommended to the North Carolina Environmental Management <br />Commission (hereinafter the EMC) that the Eno River watershed <br />area upstream from the confluence of the Eno River with the <br />Little River be designated a capacity use area pursuant to the <br />North Carolina Water Use Act of 1967 (G.S. 143 -215 et seg.); and <br />WHEREAS, the North Carolina Department of Natural Resources <br />and Community Development conducted a public hearing regarding <br />the proposed designation of a capacity use area and consulted <br />with affected water users and reservoir owners; and that after <br />these consultations, the Department recommended to the EMC that <br />Eno River water users and reservoir owners be given the <br />1 <br />
