Box 8181, Hillsborough, <br />NC 27278 <br />NORTH CAROLINA <br />ORANGECOUNTY <br />DEED OF TRUST AND SECURITY AGREEMENT <br />THIS DEED OF TRUST, AND SECURITY AGREEMENT ( "Deed of Trost") is made <br />as of this -M- day of July, 2018 by and among Habitat for Humanity, Orange County, N.C. <br />Inc., whose address is 88 Vilcom Center Drive Suite 1,110, Chapel Hill, North Carolina 27514 <br />(Borrower "), John L. Roberts whose address is P.O. Box 8181, Hillsbomugh North Carolina, <br />27278 ( "Trustee "), and Orange County whose street address is 200 S. Cameron Street, <br />Hillsborough, North Carolina 28278 ( "Lender "). <br />WHEREAS, Borrower owes Lender for money advanced or to be advanced in the <br />principal sum of ONE HUNDRED TEN THOUSAND DOLLARS (U.S. $110,000.00) (the <br />"Loan ") as evidenced by a promissory note of even date herewith (the "Note "), the final payment <br />of which is due, together with interest thereon, as provided in the Note; and <br />WHEREAS, it has been agreed that the Loan will be made subject to the terms and <br />Conditions and in reliance upon the covenants contained in the Note, this Deed of Trust, and, the <br />following documents: (Check those which apply) (Hereinafter referred to either singularly or <br />collectively, as the "Loan Documents') <br />X Development Agreement between the Borrower and Lender dated <br />X Declarations of Restrictive Covenants between Borrower and der dated <br />X Promissory Nolk front'Borrower to the Lender dated the same date as <br />and Security Document. <br />This Deed of Trust secures to Lender: (a) The repayment of the debt evidenced by the <br />Note, with interest as provided in the Note, and all renewals, extensions and modifications of the <br />Note; (b) the payment of all other sums with interest as provided in the Note, advanced to protect <br />the security of this Deed of Trust; and (c) performance of Borrower's covenants and agreements <br />
