MAJOR SUBDIVISION APPROVAL PROCEDURES <br />FINAL PLAT <br />I. APPLICATION REQUIREMENTS <br />A. Following preliminary plan approval by the Board of County Commissioners, the subdivider <br />has twelve (12) months to submit an application for Final Plat approval. At the time of <br />application, all required improvements for the subdivision must either be installed <br />according to specifications or financially guaranteed for installation within 12 months. <br />Subdivision of the property may require payment of deferred taxes under "farm use value <br />taxation ". If the property to be subdivided is currently under "farm use value taxation ", <br />please contact the Orange County Tax Office. <br />A complete Final Plat application will include: <br />1. Original mylar of the Final Plat prepared in accordance with Section V -D of the <br />Subdivision Regulations. <br />2. Department of Transportation stamp of approval on the mylar signed by the District <br />Engineer (for public roads only). <br />3. Five (5) copies of the Final Plat. <br />4. A road maintenance agreement to assure installation and /or maintenance of required <br />improvements. <br />5. Application fee. <br />B. Upon receipt of a Final Plat application, the Planning Staff will review it for <br />completeness. Incomplete applications will be returned to the applicant within five (5) <br />working days with notification of deficiencies. <br />II. REVIEW AND APPROVAL <br />A. A complete Final Plat application will be reviewed by the Planning Department for <br />compliance with all applicable regulations including conditions placed on the preliminary <br />subdivision approval. Auxiliary documents will be sent to the County Attorney for his <br />review and approval. <br />B. With the County Attorney's recommendation, the Planning Department will take action on the <br />application within 45 days and will: <br />1. Approve the application; <br />2. Approve the application subject to conditions; or <br />3. Deny the application; <br />If approved, the applicant has 90 days to record the Final Plat and auxiliary documents at <br />the Orange County Register of Deeds. If denied, reasons for denial will be stated in <br />writing to the applicant within ten (10) days. <br />The decision of the Planning Department regarding a Final Plat application may be appealed <br />to the Planning Board. <br />C. Recordation of the approved Final Plat and auxiliary documentation will be done in the <br />presence of and with the advice and consent of the Planning Department.
