The failure of the CMAR to secure any required authentication shall constitute a <br />waiver by the CMAR of any claim for the cost of that portion of the change in the Work covered by <br />a non - authenticated ticket or invoice. <br />32.19. In the event that the parties are unable to agree as to the reasonable cost and time to perform the <br />change in or addition to the Work based upon the CMAR's proposal and the Owner does not elect <br />to have the change in the Work performed on a time and material basis, Owner has the right to <br />direct in writing that the CMAR perform the change in the Work. Failure of the parties to reach <br />agreement regarding the cost and time of the performing the change in the Work regardless of any <br />pending protest, shall not relieve the CMAR from performing the change in the Work promptly and <br />expeditiously. <br />32.20. At the time of signing a change order, the CMAR shall be required to certify as follows: "I certify <br />that my bonding company will be notified forthwith that my contract has been changed by the <br />amount of this change order, and that a copy of the approved change order will be mailed upon <br />receipt by me to my surety." <br />32.21. A change order, when issued, shall be full compensation, or credit, for the Work included, omitted <br />or substituted. It shall show on its face the adjustment in time for completion of the Project as a <br />result of the change in the Work. <br />32.22. No changes will invalidate, relieve or release the CMAR from any guarantee given by him <br />pertinent to the contract provisions. No changes will affect the validity of the performance bond or <br />relieve the surety on said bond. <br />32.23. In the event of emergency endangering life or property, the CMAR and the Subcontractors may be <br />directed to proceed on a time and material basis by the Owner's Representative whereupon the <br />CMAR shall proceed and keep accurately on such form as may be required, a correct account of <br />costs together with all proper invoices, payrolls and supporting data. Upon completion of the Work <br />the change order will be prepared and settled as outlined herein. <br />33. CLAIMS FOR EXTRA COST <br />33.1. If the CMAR or any of its Subcontractors asserts that any event or occurrence has caused a change <br />in or addition to the Work which change causes an increase or decrease in the GMP or the time <br />required for the performance of any part of the Work under the Contract, including Work not <br />affected directly by the change, the CMAR shall, within ten (10) working days of such event, give <br />the Owner and Project Designer written notice as herein required. Said notice shall include the <br />instructions or circumstances that are the basis of the claim and the CMAR's best estimate of the <br />cost and time involved. The statement of claim hereunder may be included in the notice required <br />above. The statement of claim shall include all direct, indirect and impact costs associated with the <br />change, as well as the CMAR's estimate of the schedule impact of the change, if any. The CMAR <br />and its Subcontractors shall not be entitled to reimbursement or an increase in the GMP for any <br />claims that are not filed in strict conformance with this section. The CMAR shall not proceed with <br />the Work affected until further advised, except in emergency involving the safety of life or <br />property. No claims for extra compensation will be considered unless the claim is so made. The <br />Project Designer shall review and render a written decision on each claim for extra cost within <br />seven (7) days of receipt of claim. Failure to submit a timely claim for additional cost will <br />constitute a waiver of said claim. <br />33.2. The CMAR shall not act on instructions received by it from persons other than the Project <br />Designer, and any claims for extra compensation or extension of time on account of such <br />instruction will not be honored. The Project Designer will not be responsible for misunderstandings <br />claimed by the CMAR of verbal instructions which have not been confirmed in writing, and in no <br />Page 36 of 53 <br />Revised 10/17 <br />
