23 <br />for employment without regard to race, color, religion, sex, national origin, <br />political affiliation or belief, age, or handicap. <br />c. LES shall send a copy of the EEO provisions to each labor union or <br />representative of workers with which it has a collective bargaining agreement or <br />other contract or understanding. <br />d. lin the event of LES's noncompliance with these EEO provisions, any <br />Sponsor may cancel, terminate, or suspend this contract, in whole or in part, and <br />the Sponsor may declare LES ineligible for further Sponsor contracts. <br />e. Unless exempted by a Sponsor, LES shall include these EEO provisions <br />in every purchase order for goods to be used in performing this contract and in <br />every subcontract related to this contract so that these EEO provisions will be <br />binding upon such subcontractors and vendors. <br />f. The Sponsors oppose disriinzination on the basis of race and sex and <br />urge all of their contractors to provide a fair opportunity for minorities and <br />women to participate in their workforce and as subcontractors and vendors <br />under Sponsor contracts. <br />21. Patent Infringement Disclaimer. LES disclaims any and all liability for past, <br />present or future patent infringement relating to any apparatus, process, design, <br />product, composition or structure which is made, constructed, used, sold, <br />practiced, or supplied by LES at the explicit written direction, control, or order <br />of any Sponsor for the purpose of fulfilling the terms of this Agreement. Unless <br />LES knew or reasonably should have known that the same constitutes a patent <br />infringement, LES does not represent and expressly does not warrant that any <br />apparatus, process, design, product, composition, or structure which is made, <br />constructed, used, sold, practiced or supplied by LES at the explicit written <br />direction, control, or order of any Sponsor does not infringe any issued or future <br />United States or foreign patent. LFS does warrant, however, that LES has the <br />expertise and experience sufficient to perform its duties and obligations under <br />this Agreement in a proper and competent manner. Sponsor may not seek <br />indemnification from LES for any damages, attorneys fees or costs as a result of a <br />13 <br />
