DocuSign Envelope ID: 7796CD94- 342E- 40D0- B7C3- A2B604F926B4 <br />ORANGE COUNTY Department of Solid Waste Management <br />Following collection, materials must be hauled to a permitted composting facility and processed. The <br />resulting finished product containing collected materials, designated as Class -A compost according to <br />North Carolina regulation and testing, shall then be hauled back to the Orange County Solid Waste <br />Facility (1514 Eubanks Road, Chapel Hill, North Carolina) upon request of the County. It is expected that <br />compost will be requested by the County to the Contractor up to three (3) times per month. Material shall <br />be delivered loose and not contained in bags. <br />Large generators, creating on average more than fifteen (15) tons a month have different program <br />requirements than other participants. The program differences for larger customers are described below. <br />Throughout the contract term, the County plans to expand to more commercial businesses as well as <br />other entities. The maximum potential for the program includes up to two- hundred (200) total <br />businesses, fifty (50) government buildings, thirty (30) school cafeterias and at least thirty (30) multi -unit <br />apartments and condominiums. Historically, five (5) businesses and one (1) government entity have <br />been added each year. <br />2.3.1 Large Commercial Generators <br />Participants with a collection averaging over fifteen (15) tons a month for a continuous <br />duration of two years within the contract period will wont with the County and Contractor to <br />assume management and payment responsibility to the collection Contractor for organic <br />waste materials. Historically, prior to this contract, participants with high collection tonnage <br />have been subsidized for a few years until, upon mutual agreement with the participant, the <br />County, and the current contract, the participant will take over paying the contract services to <br />the business of their choosing with no County involvement. <br />The County operates a Solid Waste Management Department that is responsible for administering the <br />organic waste material collection contract and providing related program information. The Contractor will <br />be responsible for billing the County monthly for services rendered, see Section 6. The County has <br />designated the Solid Waste Management Director or their designee as the County's Representative with <br />respect to the project and shall have the authority to render decisions and interpret the contract herein. <br />Changes in services and entitlement to additional compensation shall be made by mutual written <br />amendment to this agreement executed by the County and the Contractor. The Contractor shall proceed <br />to perform the services required by the amendment only after receiving a fully executed amendment <br />from the County. <br />2.4 DIVERSION GOALS <br />The Contractor is required to assist the County in obtaining their waste and reduction goals, currently set <br />at sixty one percent (61 %). Diversion in FY16 -17 was measured at sixty two (62 %) waste reduction <br />expressed in pounds per person landfilled as compared to the base year of 1991 -1992. It is the <br />expectation that the Contractor heip the County maintain current goals or achieve new diversion goals <br />through organic waste diversion. <br />149201[rw.IVZfl <br />
