7 <br />on that Property which would comply with the Orange County Campus, DTCC Property Design <br />Guidelines, as described herein, <br />NOW, TIIEREFORE, Declazant hereby declazes that the Orange County Campus, DTCC <br />Property, being the real property described in Article I hereof, and further described in Exhibit A <br />attached hereto and incorporated herein by this reference, is and shall be held, transferred, sold, <br />conveyed, given, donated, leased, occupied and used subject to the covenants, restrictions, <br />easements, liens, chazges, and equitable servitudes (all hereinafter sometimes referred to as the <br />"Covenants") hereinaRer set forth. <br />ARTICLE 1 <br />PROPERTY <br />I.O1. PropertX. The real property which is and shall be held, transfen•ed, sold, <br />conveyed and occupied subject to this Declaration, and which is solely owned by Declarant, is <br />located in the Town of Hillsborough, Orange County, North Carolina, and is the Orange County <br />Campus, DTCC Property as defined above and as more particulazly described on Exhibit A. <br />attached hereto and incorporated herein by this reference. <br />ARTICLE 2 <br />DEVELOPMENT RESTRICTIONS <br />2.01. Use Restriction. The Orange County Campus, DTCC Property shall be used only <br />for a public library (as that use is generally understood) and for a community college campus, <br />which campus use shall include typical campus buildings containing classrooms, related offices, <br />libraries, and any necessary support or accessory uses, not including dormitories or residential <br />units, but including and not limited to snack bars or cafeterias, all to be located on the interior of <br />campus buildings, Pazking lots and access drives as necessary aze allowed as accessory to the <br />library or campus uses, provided that pazking shall be located on the interior of the Orange <br />County Campus, DTCC Property so as not to be substantially visible from Waterstone Drive and <br />College Park Road, <br />ARTICLE 3 <br />DEVELOPMENT REVIEW <br />3.01. Development Approval. In conjunction with its development of the Waterstone <br />Project, Declarant may in its sole discretion appoint an Architectural Control Committee (the <br />"ACC"), No building, structure, or other improvement (including but not limited to drives, <br />pazking azeas, utilities, landscaping, hazdscaping, recreational facilities and the like) shall be <br />erected, constructed, placed, altered (by addition or deletion) or maintained on any portion of the <br />Orange County Campus, DTCC Property unless and until design and location documents aze <br />2308134.05 <br />rai: CN <br />
