<br />FINANCIAL IMPACT: This Agreement, once executed, will stipulate a pre-construction fee that <br />will compensate the CMAR up to the BOCC’s potential authorization of the GMP. This pre- <br />construction fee will be negotiated as part of the process with the preferred qualified CMAR <br />candidate. Should the BOCC not approve the GMP and choose not to proceed with the project, <br />the pre-construction fee is paid to the CMAR and the Agreement is terminated. Funds for these <br />services are appropriated as part of the Capital Project budget. <br /> <br />RECOMMENDATION(S): The Manager recommends the Board delegate authority to the <br />County Manager to: <br />a) award a Construction Manager at Risk (“CMAR”) Agreement to a qualified firm for <br />the Orange County Northern Campus capital project; and <br /> <br />b) authorize the Manager to sign the necessary paperwork upon review by the <br />County Attorney. <br /> <br />3
