FINANCIAL IMPACT: This Agreement, once executed, will stipulate a pre-construction fee that will compensate the CMAR up to the BOCC’s potential authorization of the GMP. This pre- construction fee will be negotiated as part of the process with the preferred qualified CMAR candidate. Should the BOCC not approve the GMP and choose not to proceed with the project, the pre-construction fee is paid to the CMAR and the Agreement is terminated. Funds for these services are appropriated as part of the Capital Project budget. RECOMMENDATION(S): The Manager recommends the Board delegate authority to the County Manager to: a) award a Construction Manager at Risk (“CMAR”) Agreement to a qualified firm for the Orange County Northern Campus capital project; and b) authorize the Manager to sign the necessary paperwork upon review by the County Attorney. 3
