26 <br /> <br />• Allows staff (i.e. Planning, Environmental Health, etc.) to review and 1 <br />comment on the proposal. 2 <br />• There is a $140.00 application fee. 3 <br />– Final Plat: 4 <br />• Completed by surveyor. 5 <br />• Approved by Planning, Environmental Health, and signed off by School 6 <br />Board (CAPS). 7 <br />• There is a $140.00 application fee. 8 <br />• New law means a 3 lot division of property, meeting criteria, is only required to submit a 9 <br />Final Plat containing the information required under NC General Statute 47-30. 10 <br />• Staff cannot require they go through the Concept Plan application process or even apply 11 <br />for Environmental Health (i.e. septic and well) review. 12 <br />• All staff can do is verify is that they meet the aforementioned applicable criteria. 13 <br /> 14 <br />Proposal: 15 <br />Staff is proposing to amend the UDO to incorporate these changes in order to ensure local land 16 <br />use regulations are consistent with applicable State law. 17 <br /> 18 <br />Please note if the amendment is not adopted, the County is still obligated to process requests 19 <br />consistent with applicable State standards. 20 <br /> 21 <br />Recommendation 22 <br />The Manager recommends the Board: 23 <br />1. Receive the proposed amendments; 24 <br />2. Conduct the public hearing and accept comment; 25 <br />3. Close the public hearing. (Note that, because this is a legislative decision, additional 26 <br />comments at a later date are permitted); and 27 <br />4. Decide on one of the following options: 28 <br />a. Adopt the proposed amendments by approving the Statement of Consistency 29 <br />(Attachment 4) and Ordinance (Attachment 5). 30 <br />b. Defer a decision to a later BOCC regular meeting date. 31 <br />c. Refer the item back to the Planning Board for a specific purpose. 32 <br /> 33 <br />Commissioner Marcoplos asked if well and septic systems still go through the process. 34 <br />Michael Harvey said under the current regulator process, the County can compel people 35 <br />to go through the process as part of concept plan review. He said applicants seeking an 36 <br />expedited process are encouraged to voluntarily go through the process before they record, so 37 <br />if there are any modifications to the plat, it is better to know this prior to paying fees to have the 38 <br />document recorded. He said Environmental Health has tried its best to accommodate the fact 39 <br />that State law says the process can be skipped, to a certain degree. 40 <br />Commissioner Marcoplos said the intent here is to help people go through the process 41 <br />more quickly. 42 <br /> 43 <br />A motion was made by Commissioner Burroughs, seconded by Commissioner Jacobs 44 <br />for the Board to open the public hearing. 45 <br /> 46 <br />VOTE: UNANIMOUS 47 <br /> 48 <br />NO PUBLIC COMMENT 49 <br /> 50
