Animal Control Ordinance <br />DRAFTv.3 - 8/15/2013 Page 25 <br /> <br />Sec. 4-46. - Rabies control. <br />It shall be unlawful and a violation of this Ordinance for any animal owner, <br />keeper or other person to fail to comply with the laws of North Carolina relating to the <br />control of rabies. <br />(Ord. of 6-16-1987, § XVI, eff. 1-1-88) <br />Sec. 4-47. - Rabies vaccination tag. <br />All dogs and cats shall wear a valid rabies vaccination tag. Cats and ferrets are not <br />required to wear tags but the owner or custodian of such animal shall provide proof that the cat <br />or ferret has been vaccinated against rabies. The owner or custodian of all animals required to <br />be vaccinated against rabies shall provide proof of vaccination upon demand of a law <br />enforcement or animal control officer if an animal required to be vaccinated is not wearing a <br />rabies vaccination tag. Failure to produce proof of vaccination may result in such animal being <br />impounded subject to redemption in the manner provided in this Chapter. Such proof being the <br />certificate of vaccination from a licensed veterinarian or a certified rabies vaccinator. <br /> (Ord. of 6-16-1987, § XVII, eff. 1-1-88; Amend. of 12-2-1996, eff. 1-1-97) <br />Sec. 4-48. - Applicability to veterinarians. <br />Hospitals, clinics and other premises operated by licensed veterinarians for the <br />care and treatment of animals are exempt from the provisions of this Ordinance except <br />for the provisions relating to cruelty to animals and rabies control. <br />(Ord. of 6-16-1987, § XVIII, eff. 1-1-88) <br />Sec. 4-49. - Reserved. <br />Editor's note— <br />Section 4-49 entitled kennel standards replaced by Sections 4-71 and 4-72 and derived <br />from Ord. of 6-16-1987, § VIII, eff. 1-1-88; Amend. of 12-3-2007, eff. 7-1-08. <br />Sec. 4-50. - Reserved. <br />Editor's note— <br />Section 4-50 entitled permits and standards for animal collection replaced by Sections 4- <br />96 through 4-99 and derived from Ord. of 6-16-1987, § XX, eff. 1-1-88; Amend. <br />of 12-3-07, eff. 7-1-08. <br />Sec. 4-51. - Penalties. <br />The following penalties shall pertain to violations of this Ordinance. <br />(a) The violation of any provision of this Ordinance shall be a misdemeanor and any <br />person convicted of such violation shall be punishable as provided in North Carolina <br />General Statutes § 14-4, or other applicable law. Each day's violation of this <br />Ordinance is a separate offense. Payment of a fine imposed in criminal proceedings <br />pursuant to this subsection does not relieve a person of his liability for taxes, fees or <br />civil penalties imposed under this Ordinance.
