Harvey, Planner III, (919) 245-2597 <br />Craig Benedict, Director, (919) 245-2575 <br /> <br />PURPOSE: To hold a public hearing on a Planning Director initiated Unified Development <br />Ordinance (UDO) text amendment revising regulations governing the processing of subdivision <br />applications to incorporate recent changes in State law. <br /> <br />BACKGROUND: On May 4, 2017, Session Law 2017-10 (Attachment 2) modified the review of <br />subdivision proposals by local governments, specifically: <br />1. Created a new category of exempt subdivision. <br />STAFF COMMENT: There are currently 4 categories of exempt subdivision (i.e. <br />activities that do not constitute a division of land and are expressly exempt from <br />established review and approval processes) specifically: <br />a. Combination/recombination of existing parcels so long as the resultant lots <br />are equal to or exceed local standards and do not result in an increase in <br />the total number of existing parcels; <br />b. Division of land into 10 acre parcels of property; <br />c. Public acquisition of land for widening/opening streets; and <br />d. Division of land in single ownership, the entire area of which is no greater <br />than 2 acres, into not more than 3 lots if no street dedication is involved and <br />the lots are equal to/exceed local regulations. <br />1
