Attachment #3 4 <br />A RESOLUTION RECOGNIZING ORANGE COUNTY VOLUNTARY <br />AGRICULTURAL (VA) DISTRICT PROVISIONS REGARDING EXTENSION <br />OF WATER AND SEWER LINES BY MUNICIPALITIES AND PUBLIC <br />UTILITIES <br />WHEREAS, in August 1992, Orange County became one of the first counties in North <br />Carolina to implement a Voluntary Farmland Protection Program Ordinance as permitted <br />by the North Carolina General Statutes, and <br />WHEREAS, since that time, 10 farms totaling 1,631 acres have enrolled in the VA <br />District program, and <br />WHEREAS, one of the provisions protecting farms in these districts is a waiver of water <br />and sewer assessments for the extension of lines that may cross or touch a VA District <br />farm, including an abeyance of assessments, without interest, until improvements on the <br />property are connected to the water or system in question; and <br />WHEREAS, the ordinance containing these provisions currently applies only to Orange <br />County- operated water and sewer systems, and <br />WHEREAS, the protection of farmland and rural character is a goal shared by the <br />municipalities and public utilities of the County, and all of the VA District farms are <br />located in areas of the County projected to remain rural over time: <br />NOW, THEREFORE, BE IT RESOLVED that the agrees that the <br />preservation of farmland through the Voluntary Agricultural District program is of <br />mutual interest to the as well as the County as a whole, and agrees to abide <br />by the provisions in Article XIII of the Orange County Voluntary Farmland Protection <br />Program Ordinance to this end regarding the waiver or abeyance of water and sewer <br />assessments of any future line extensions that may cross or touch a VA District farm. <br />This, the _ day of , 2004. <br />
