w <br />v <br />1 <br />2 D. Renewal of Conservation Agreement <br />3 <br />4 Prior to the expiration of the 10 -year. Voluntary Conservation Agreement defined herein, the <br />5 owners of the District may sign a letter of renewal for an additional 10 -year period which <br />6 will be attached as an appendix to the original conservation agreement and recorded. <br />7 Conservation Agreements not renewed prior to the expiration of the 10 year period must file <br />8 a new application for District designation. <br />9 <br />to ARTICLE IX <br />11 REVOCATION OF PRESERVATION AGREEMENT <br />12 <br />13 By written notice to the Board, a landowner of qualifying farmland may revoke the <br />14 Conservation Agreement or the Board may revoke the same Conservation Agreement based <br />15 on noncompliance by the landowner, subject to the same provisions as contained in Article <br />16 VIII for appeal of denials. Such revocation shall result in loss of qualifying farm status and <br />17 loss of eligibility to participate in a district. Absent noncompliance by the landowner, neither <br />18 the Board nor the Board of Commissioners shall revoke any conservation agreements prior <br />19 to its expiration. <br />20 <br />21 ARTICLE X <br />22 PUBLIC HEARINGS <br />23 <br />24 A. Purpose <br />25 <br />26 Pursuant to N.C.G.S. §106-740, which provides that no state or local public agency or <br />27 governmental unit may formally initiate any action to condemn any interest in qualifying <br />28 farmland within a District until such agency or unit has requested the Board to hold a public <br />29 hearing on the proposed condemnation. <br />30 <br />31 B. Procedure <br />32 <br />33 1. Upon receiving a request, the Board shall publish notice describing the proposed <br />34 action in the appropriate newspapers of Orange County within five (5) business days <br />35 of the request, and will in the same notice notify the public of a public hearing on the <br />36 proposed condemnation, to be held within ten (10) days of receipt of the request. <br />37 <br />38 2. The Board shall meet to review: <br />39 <br />40 a. Whether the need for the project has been satisfactorily established by the <br />41 agency or unit of government involved, including a review of any fiscal <br />42 impact analysis conducted by the agency involved; and <br />43 <br />8 <br />
