DESCRIPTION OF <br />PROPERTY: All of the 15.65 acre lot at the southwest intersection of Davis Road (SR <br />1129) and Old NC 86 shown on the plat and survey by Steve F. Yuhasz, <br />Registered Land Surveyor, entitled Property Surveyed for Hillsborough <br />United Church of Christ and recorded on Plat Bonk 55, Page 74 of the <br />Orange County Registry, hereinafter referred to as "the property". P.I.N. <br /># 9862 -99- 7320. <br />SPECIAL TERMS AND CONDITIONS <br />The Board of Adjustment of Orange County approved granting a CLASS B SPECIAL USE PERMIT <br />on July 11, 2005 applicable to the property. The project subject to this SPECIAL USE PERMIT is <br />described above and shown on the Site Plan by John C. Williams, Registered Architect dated October <br />1, 1997. Christa Niven and Martha Lee will each operate a day care facility on the property. The terms <br />herein contained are binding on the present owners and lessees and their successors in title and in <br />interest until the expiration of this permit and any extension of its expiration date, until such time as <br />this permit is otherwise changed by government action. <br />The existing facility, and all other site improvements shall be operated in accordance with the site Plan <br />dated October 1, 1997 and all impact and safety commitments shall be as contained in the narrative <br />statement of the project all of which are incorporated herein and made a part of this Special Use <br />Permit. Copies of the final site plan and supporting documentation are on file in the Orange County <br />Planning and Inspections Department. Except as detailed on the Site Plan, the property will remain and <br />be maintained in its natural condition. The conditions of approval are as follows: <br />Existing vegetation shall be maintained as indicated on the site plan. <br />2. If any condition of this Special Use Permit shall be held invalid or void, then this Special Use <br />Permit shall be void in its entirety and of no effect. <br />3. The Special Use Permit will automatically expire within 12 months from the date of approval if <br />the use has not commenced or construction has not commenced or proceeded unless a timely <br />application for extension of this time limit is approved by the Board of County Commissioners <br />as provided in 8.4.11 of the Orange County Zoning Ordinance. <br />4. Within 90 days from the beginning of operation of The Little School clay care facility all <br />requirements to obtain a State of North Carolina day care license roust be met. <br />5. Fencing and/or screening shall be provided and maintained which assures the protection of the <br />children receiving day care, protects adjacent residentially developed properties from. trespass, <br />effectively screens the view of any outdoor playing area, and reduces noise associated with the <br />operation of the cay care facility. <br />6. Adequate access to and from the site as well as adequate space off the road right -of -way shall <br />be provided and maintained for the safe pick -up and discharge of children and shall be provided <br />in such a manner that traffic generated by the day care facility is not disruptive to adjacent <br />residentially developed properties. <br />90 <br />V4 <br />
