He said there is precedent for making such <br />requests in this forum, and he believes his comments are consistent with previous BOCC <br />action. <br />Commissioner McKee said he had a level of concern at that meeting as well, but his <br />concern is greater this evening. <br />Commissioner Marcoplos said one of the fundamental questions is whether this road is <br />going to be built to any standard of quality, and the answer is that it is being built to the <br />standards of the UDO, which indicates it will be built to a level of quality that makes it a bona <br />fide road. <br />Patrick Mallett said it has to meet one or the other: Class A standard for private roads, <br />or DOT standards. <br />Commissioner Marcoplos said he believes it is a functional road system. <br />Commissioner Rich said this is not the first time that the developer has heard about <br />affordable housing, and she apologized if he was insulted. She said the BOCC is strongly <br />committed to encouraging developers to consider affordable housing, and how they may help. <br />Chair Dorosin said he was not apologizing, as he does not think his comments were out <br />of turn. <br />Commissioner Rich said she wanted to apologize if anyone was insulted. <br />Commissioner Price said she does not see any way that the BOCC can prevent this <br />from proceeding, as it will be built to County standards. <br />Chair Dorosin said the BOCC can vote it down, and the developer will have to go to an <br />exempt subdivision. <br />Commissioner Price said she does not see on what grounds the BOCC could vote this <br />down. <br />Chair Dorosin said on the grounds that the permit said the road would be built to DOT <br />standards, and it is not. <br />Commissioner Price said she takes issue with the construction having already <br />proceeded, but if the developer plans to build to the County’s standards, she does not see how <br />the BOCC can stop it. <br />Chair Dorosin said the developer cannot build to County standards unless the BOCC <br />gives approval of this modification this evening. <br />Commissioner Price said she does not see grounds upon which the BOCC can deny <br />approval. <br />Patrick Mallett said the developer’s plan B would be an exempt subdivion, and would <br />proceed onwards with ten lots.
