Town of Carrboro Board of Adjustment Information submitted by Orange County <br />appointee Will Heflin, who was unable to attend. <br />00- Quasi-judicial <br />110- Anyone presenting to the Board is sworn in (including Town staff) <br />► Duties are specific and outlined in both the Town's Land Use Ordinance and <br />State Statutes <br />11,- We are reactionary—we respond to applications <br />11► Town of Carrboro Board of Adjustment <br />The Board of Adjustment shall hear and decide: <br />10-- Appeals from any order, decision, requirement, or interpretation made by the <br />administrator <br />11o, Applications for special use permits <br />Oil, Applications for variances <br />► Applications for special exception permits <br />► Questions involving interpretation of the zoning map, including disputed <br />district boundary lines and lot lines <br />llo- Applications for major subdivisions containing between five and twelve lots <br />0-- Any other matters the board is required to act upon by any other town <br />ordinance <br />10-- Town of Carrboro Board of Adjustment <br />Section 15-92 <br />Variances <br />► Town of Carrboro Board of Adjustment <br />Subject to the remaining provisions of this section, when unnecessary hardships would <br />result from carrying out the strict letter of this ordinance, the board of adjustment shall <br />vary any of the provisions of the ordinance upon a showing of all of the following: <br />► (1) Unnecessary hardship would result from the strict application of this <br />ordinance. It shall not be necessary to demonstrate that, in the absence of the <br />variance, no reasonable use can be made of the property, <br />► (2) The hardship results from conditions that are peculiar to the property, such as <br />location, size, or topography. Hardships resulting from personal circumstances, <br />as well as hardships resulting from conditions that are common to the <br />neighborhood or the general public, may not be the basis for granting a variance <br />Op- (3) The hardship did not result from actions taken by the applicant or the property <br />owner.
