As late as May 18, 2015, when the Planning Director authorized an extension of the <br />approved Preliminary Plat consistent with Section 2.15.3 (G), the developer was <br />reminded that internal roadways had to be developed to applicable NCDOT public <br />road standards. <br /> <br />Please refer to Attachment 2 for additional detail. <br /> <br />c. Why was this not caught at the permitting stage? <br />STAFF COMMENT: Orange County staff (i.e. Current Planning, Engineering and <br />Erosion Control, etc.) reviewed various plans (concept plan, preliminary plan, erosion <br />control, stormwater, etc.) indicating the roadways would be developed/constructed to <br />the applicable NCDOT public road standard(s). <br /> <br />There is a disagreement between the engineer for this project and local NCDOT staff <br />with respect to what is necessary/allowed/required to comply with applicable public <br />road standards, including but not limited to: <br />i. Required permit authorization(s) from NCDOT prior to the commencement of <br />land disturbing activity; <br />ii. Required improvement(s) for stream crossing(s); <br />iii. Allowable slopes and associated easements; <br />iv. Required/mandatory NCDOT inspections; and <br />v. General construction requirement(s). <br /> <br />County staff typically does not review these elements. Adherence to NCDOT road <br />standards is solely NCDOT’s purview. <br /> <br />Staff agrees with several BOCC member comment(s) from the April 3, 2018 regular <br />meeting that all this could have been avoided with better communication between the <br />project engineer and NCDOT staff prior to the initiation of land disturbing activity. <br /> <br />d. If approved, will this request impact previously approved open space? <br />STAFF COMMENT: No, the total area preserved as open space for this project shall <br />remain at approximately 1,678,305 square feet of land area or 38.53 acres. <br /> <br />e.
