Receive the Planning Board and Planning Director’s recommendations on the 22
Preliminary Plat application for the revised Triple Crown Farms Subdivision, 23
2. Discuss the proposal as desired, and 24
3. Approve the Preliminary Plat as submitted and the Resolution of Approval contained in 25
Attachment 9. 26
27
Patrick Mallett said if the BOCC makes this change, there would need to be a disclosure 28
statement that acknowledges that these are privately maintained roads, and changing them to 29
NC Department of Transportation (DOT) public maintained roads would require significant 30
design, permitting, construction, and cost. 31
Chair Dorosin asked if that is included in the recommendations and resolution. 32
Patrick Mallett said yes, and that language would also be included in the road 33
maintenance agreement. He said the developer has met with DOT, and realized it would be 34
unable to meet DOT standards without great disturbance and significant cost, and, therefore, 35
needed to change the status of the roads. 36
Commissioner Rich referred to the disclosure statement, and asked if this transfers with 37
the sale of the home from one homeowner to the next. 38
Patrick Mallett said he would think it would, and the County would require that this be 39
recorded with the plat. He said the closing agent would have a copy of the plat, and all recorded 40
documents that are associated with the property. 41
John Roberts said it would show up in the title search. 42
Commissioner McKee referred to the third photograph, and said he sees a culvert 43
already installed. 44
Patrick Mallett said it is a metal conspan that is in the process of being installed. 45
Commissioner McKee said he thought that the need to install a bridge would be a major part of 46
the additional expense, but he sees the sub-structure of the bridge in place with no roadbed on 47
top. He asked if the additional expenses could be identified. 48
Patrick Mallett said he would let the developer speak to that. 49
Commissioner McKee asked if the other crossings already preliminarily installed as well. 50
