Page 3 of 51 <br /> (g) Any other expenses determined by the Board or approved by the Members to be <br />common expenses of the Association. <br /> Section 1.4. "Common Area" shall mean all real property over which the Association <br />has an easement or a deed for the common use and enjoyment of the Owners subject to the <br />Declaration and the Association Bylaws. The Common Area to which an easement or deed shall <br />be granted and which shall be maintained by the Association at the time of the conveyance of the <br />first Lot is more particularly described in Exhibit B attached hereto and by reference made a part <br />hereof. The uses of the Common Areas shall be limited by subsequent provision contained in <br />these Declarations and/or the Home Owners' Association documents. The Common Areas <br />maintained by the Association shall include, but may not be limited to the areas shown and <br />delineated as Common Area in the Survey, and any portion of the public roads dedicated to but <br />not yet maintained by any public body. Declarant, for itself, its successors and assigns, hereby <br />reserves to itself the right to substitute a modified legal description of Common Area earlier <br />conveyed to the Association. Such modified legal description shall be based on a survey of the <br />Common Area after all improvements are in place. The Association hereby irrevocably appoints <br />and constitutes Declarant as its attorney in fact with the power to substitute the aforesaid <br />modified legal description so that there are no discrepancies or encroachments between any Lots <br />or the Common Area. This power of attorney is reserved and granted pursuant to N.C.G.S. 32A <br />and shall be appurtenant to and run with the land. All references to “Open Space” and/or “Open <br />Space Easement” in the Survey shall mean and refer to Common Area. <br /> Section 1.5."Declarant" will mean and refer to 16 Parkside Lane, LLC, its successors, <br />and assigns, to which the rights of Declarant hereunder are expressly transferred, in whole or in <br />part, and subject to such terms and conditions as Declarant may impose. <br />52
