39 <br />E <br />As Outline in your Concept Subdivision Program date April 18, 2015, you are not <br />proposing any major changes to the plan, and my staff has verified that the request <br />would comply with our current regulations. <br />therefore hereby approve your request for an administrative re- approval of the <br />preliminary plat. This re- approval is only good for twenty -four (24) months, so long as <br />you can document material progress during the next twelve (12) months (i.e. June 18, <br />2016). If you cannot demonstrate material progress, then administrative approval for <br />the second twelve (12) months shall be rescinded. There are no additional <br />opportunities for re- approval of an expired Plat. <br />The practical implication is that all required infrastructure shall be installed and /or <br />properly bonded in accordance with the provisions of County regulations, and the <br />required Final Plat application package is submitted to our Department for processing <br />as required under Section 2.15.4 of the LIDO. <br />You are also requesting approval to prepare a Plat for the subject are for the <br />purposes of defining "sub -lots" #9 and #10, which front onto Triple Crown Drive; the <br />open space to the rear of these lots and the remainder of the subdivision area(s). This <br />will allow you to record those two residential lots which already have frontage and <br />access to public streets and an proportional area of open space, which will be recorded <br />as Primary and/o, Secondary Open Space as indicated on the approved Triple Crown <br />Farms Major Subdivision. <br />You are hereby authorized to prepare the proposed Plat with the following <br />conditions and /or items of understanding. <br />1. Acknowledgement that this Plat does not constitute a "Phasing" of the <br />subdivision. <br />2. Orange County must receive documentation by NCDOT that Triple Crown Drive <br />has been dedicated as a public road with the proper rights -of -way, constructed to <br />NCDOT roadway standards and accepted into their state road maintenance <br />program. <br />3. All the remaining Primary and Secondary Open Space easements for the <br />remainder of the subdivision are recorded with the next Plat. <br />4. Required between lot plantings and 30' wide roadside buffer materials along <br />Dairyland Road and Triple Crown Drive are installed (or preserved) prior to the <br />issuance of a Certificate of Occupancy (CO). <br />5. The required Orange County Parkland and Recreation fees and payments in lieu <br />are paid prior to recordation for the two lots. <br />6. Orange county Stormwater and Erosion Control Division reviews the proposed <br />Plat to ensure that proper erosion control and or stormwater measures are met <br />either on the two lots or within the recorded open space to the rear of the lots. <br />
