35 <br />NC DOT for maintenance in the future. As a result NC DOT will need to <br />review and comment on the roadway design. <br />iv. Final design of the stormwater fire pond shall be addressed at this stage by <br />yourself and Orange County Emergency Services to ensure a properly sized <br />pond. <br />As we understood from out last conversation the pond may actually be re- <br />configured to address fire suppression needs of the development only, which <br />may cause the pond to be reduced in size. <br />v. NC DOT will need to issue a driveway permit for the project if Triple Crown <br />Drive is accepted for public maintenance. <br />B. STEP TWO — COMPLETION/REVISION OF FINAL PLAT APPLICATION <br />ANCILLARY DOCUMENT(S): In preparation for submitting the Final Plat application <br />package, you are required to complete the following document(s) associated with your <br />specific project. Please note the Final Plat application package will not be accepted, or <br />considered complete without all required documents as detailed on the actual application <br />and /or referenced herein: <br />i. Road Maintenance Agreement (RMA): You will need to prepare a document <br />detailing the perpetual care and maintenance of the roadway as approved <br />within the approved Preliminary Plat. <br />The agreement previously submitted was sufficient, with respect to form and <br />content, but contained several errors inconsistent with the approved project, <br />most notably erroneous references to the classification of roadway throughout <br />the document. We recommend your client's attorney review this draft and re- <br />submit for review by staff. <br />Please remember you are required to develop /improve said private roads <br />consistent with the approved Preliminary Plat. Note, if you elect to bond <br />some of the roads as allowed in the UDO Section 7.4, you must submit the <br />required items to execute the performance bond(s) and guarantees. <br />Per Section 7.8.5 of the UDO you will need to submit a letter providing a <br />name for the approved roadway. This document shall be submitted to Orange <br />County Land Records who shall make the formal determination as its <br />approvability. <br />ii. Declarations, Restrictive Covenants, easements and legal descriptions. You <br />will need to provide copies of all legal documents associated with the <br />construction/installation, perpetual ownership and maintenance of all entries, <br />common areas, open space, buffers, and access areas. <br />C. STEP THREE — SUBMISSION OF FINAL PLAT APPLICATION PACKAGE: <br />Per Section 2.15 of the UDO the following information shall be required as part of the <br />Final Plat application package: <br />Completed and signed Final Plat application form, <br />ii. Documentation denoting all conditions, referenced within the attached Resolution <br />of Approval, have been adhered to, <br />3 <br />
