2, / -7 .5-7 q <br />STATE OF NORTH CAROLINA PUBLIC TRANSPORTATION GRANT <br />AGREEMENT FOR BUSES AND BUS <br />FACILITIES <br />COUNTY OF WAKE PROGRAM — SECTION 5339 <br />NORTH CAROLINA <br />DEPARTMENT OF TRANSPORTATION <br />FAIN NUMBER: NC- 2016 - 007 -00 <br />NC- 2017 - 050 -00 <br />and CFDA NUMBER: 20.526 <br />PROJECT NUMBER: 18- 39 -056U <br />DUNS # 091575191 <br />THIS AGREEMENT made this the day of U91M 20-P7, (hereinafter referred to as <br />AGREEMENT) by and between the NO TH CAR LINA DEPARTMENT OF TRANSPORTATION <br />(hereinafter referred to as "Department ", an agency of the State of North Carolina) and ORANGE <br />COUNTY, (acting in its capacity as the grant recipient hereinafter referred to as the "Grantee "). <br />WHEREAS,49 U.S.C. Chapter 53 of in the above referenced Federal grant program including, <br />but not limited to; section 5305 (5303 & 5304) Metropolitan & Statewide Planning and Non - <br />Metropolitan Transportation Planning, 5307 Urbanized Area Formula Grants, 5310 Enhanced Mobility <br />of Seniors & Individuals with Disabilities, 5311 Formula Grants for Rural Areas, 5339 Buses and Bus <br />Facilities Grants Program, 5311(f) Intercity Bus, awards of federal discretionary grants, and <br />assistance under the Tribal Transit Program, and/or State grant program including, but not limited to, <br />Advanced Technology, Intern /Apprentice program, Urban State match programs, Rideshare, ROAP <br />and SMAP. <br />WHEREAS , the funds provide federal administrative, operating, and capital assistance for public <br />transportation in rural and small urban areas by way of a formula grant program to be administered by <br />the State; and <br />WHEREAS, the purpose of this grant is to enhance access of people in small urban and <br />nonurbanized areas for purposes such as health care, shopping, education, recreation, public services, <br />and employment by encouraging the maintenance, development, improvement, and use of public <br />passenger transportation systems; and <br />WHEREAS, the Grantee has been designated as the recipient of these funds, and <br />WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes (N.C.G.S.) <br />designated the Department of Transportation as the agency of the State of North Carolina responsible <br />for administering all Federal and /or State programs relating to public transportation, and granted the <br />Department authority to do all things required under applicable Federal and /or State legislation to properly <br />administer the public transportation within the State of North Carolina; and <br />WHEREAS, the Governor of North Carolina has designated the North Carolina Department of <br />Transportation as the agency to receive and administer Federal funds, in accordance with the relevant, <br />section of the Fixing America's Surface Transportation (FAST) Act, Public Law No. 114 -94, December <br />4, 2015, and other authorizing legislation that may be enacted, the Moving Ahead for Progress in the <br />21st Century Act (MAP -21), Public Law No. 112 -141, July 6, 2012, as amended by the "Surface <br />Transportation and Veterans Health Care Choice Improvement Act of 2015," Public Law No. 114 -41, <br />July 31, 2015, and the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for <br />Updated 05/27/2015 <br />
