Closed Right-of-Way Transfer to Adjoining Property Owners Map <br /> <br />Background <br />North Carolina General Statute (NCGS) §153A-241 (Attachment 1) provides the state <br />law for closing public roads or easements in counties that are not under the control and <br />supervision of the North Carolina Department of Transportation (NCDOT). The process <br />is for public roads or easements whose maintenance has been abandoned by NCDOT. <br />Additionally, per Orange County Municipal Ordinance Section 22 – Land Records, a <br />Property Identification Number (PIN) is required to be assigned to the portions of the <br />closed right-of-way (Attachment 2). Therefore, the road closing process also requires <br />the completion of a survey and deed(s) for the right-of-way, to facilitate the recording of <br />the Order to close and the transfer of property to adjacent property owners. <br /> <br />Eubanks Road Realignment <br />A recent local project provides a good example of how this process works. A portion of <br />Eubanks Road (SR 1727) between Old NC 86 and Dromoland Road was realigned to <br />provide for improved intersection sight distance, as a NCDOT secondary paved road <br />improvement project. The project has been completed and NCDOT has now formally <br />abandoned maintenance of the old road alignments, including removal of the pavement. <br />The realigned (new) portion of Eubanks Road has been added to the State Maintained <br />Secondary Road System (Attachment 3). <br />13
