11 <br /> <br />The purpose of this hearing will be to gather evidence to determine whether the <br />ordinance’s standards have been met. The Board must base its decision with respect to <br />the approval or denial on the application solely on the competent, material and <br />substantive evidence presented during the hearing. The Board must exclude from <br />consideration both their personal and the public’s opinions with respect to the <br />disposition of this request. <br /> <br />3. Chair Dorosin declared the public hearing open and asked all parties intending to offer <br />testimony and/or evidence to come forward and be sworn by the Clerk. <br /> <br />The Deputy Clerk administered the oath indicating that the testimony the individual is <br />about to give is the truth, the whole, truth, and noting but the truth to their knowledge. <br />Any individual offering testimony (i.e. staff, the applicant, members of the public, <br />Planning Board, etc.) has to be sworn. <br />** NOTE : Unlike public hearings on legislative matters there is no time <br />limit as individuals are presenting sworn evidence/testimony on the <br />merits of the application.** <br /> <br />Three individuals were sworn in: Applicant, Michael Harvey, Supervisor/Planner III, and <br />Patrick Mallett, Planner II <br /> <br />4. Pat Mallett, Current Planning. I’ve been duly <br />sworn. Before I go through the presentation, I am going to walk you through <br />the large stack of what you’re dealing with. With a special use permit, you tend <br />to have a lot of paperwork. You should have at each of your places: a hard <br />copy of the PowerPoint presentation; a larger stack that is the abstract on the <br />front end, and all the ten attachments; 11x17 version of the site plan; and then <br />the script that follows through the process for a special use permit.
