Include in the base bid the cost of the following warranties: <br />Contractor's 5 -year material and labor warranty for shingle roofing <br />a. Roof systems from and including slate roofing, underlayment, and all <br />related components and accessories for all new roof systems <br />b. Sheet Metal Flashing <br />C. Caulking and Sealants <br />d. All other items included in the project but not necessarily referenced <br />herein <br />C. The warranties shall also state that the Owner has the right, at any time during the 5 -year <br />Contractor's warranty period and the Manufacturer's warranty period, to make <br />emergency repairs to protect the contents of the building or the building itself from <br />damage due to leaking. The cost of emergency repairs made during the first five years of <br />the warranty period shall be borne by the Contractor and action by the Owner shall not <br />invalidate the warranty. <br />D. Emergency repairs to defects and leaks shall be performed by the Contractor as soon as <br />possible on receiving notice from the Owner. As soon as weather permits, permanent <br />repairs and restoration of affected areas shall be accomplished in a manner in <br />conformance with the original contract requirements. Permanent repair or replacement of <br />the affected area(s) shall be made by the manufacturer within thirty days unless mutually <br />extended by both parties. The work shall be done without additional cost to the Owner, <br />except if it is determined that such leaks and defects were caused by abuse, lightning, <br />hurricane, tornado, hail storm, or other unusual phenomena. <br />E. The Contractor's warranty shall neither replace nor negate any agreement furnished by <br />the manufacturer. The warranties shall not be negated or become void due to a transfer <br />of ownership. The warranty shall state that: <br />1. When, within the warranty period, should the roofing system become non- <br />watertight, split, tear, blister, or separate at the seams, or show any other <br />evidence of excessive weathering because of defective materials or <br />workmanship, the repair or replacement of defective materials and correction of <br />defective workmanship shall be the responsibility of the manufacturer. <br />2. When the manufacturer or the manufacturer's approved applicator fails to <br />perform repairs within 72 hours of notification, emergency repairs performed by <br />others will not void the warranty. <br />F. With regard to the repair of leaks under the terms of the manufacturer's No Dollar Limit <br />warranty, the manufacturer shall replace insulation which has been damaged by leakage <br />when that insulation contains detrimental amounts of moisture. <br />G. In addition, should the roof system experience recurring leaks (more than two in a given <br />section of the roof system) over a period of 12 consecutive months, the building Owner <br />may request an inspection of that portion of the roofing system experiencing recurring <br />leaks by the manufacturer or the Owner's designated representative. The contractor shall <br />then follow the recommendations of the inspector as to appropriate resolution of the <br />problem. <br />17 -198 Warranties <br />017850.2 <br />
