c. Land Use Goal 3: A variety of land uses that are coordinated within a program <br />and pattern that limits sprawl, preserves community and rural character, minimizes <br />land use conflicts, supported by an efficient and balanced transportation system. <br />4. Staff has determined that the proposed subdivision is consistent with the provisions and <br />goals of the Joint Planning Land Use Plan and Joint Planning Agreement. <br />5. Staff recommends that if the Planning Board recommends approval of the revised <br />Preliminary Plan that it consider also recommending conditions of approval that address <br />the Road Maintenance Agreement (RMA); Design Standards; and Disclosure Statements <br />regarding the private roads as outlined in this abstract. <br /> <br />RECOMMENDATION: The Planning Director recommends the Board: <br /> <br />1. Receive the Preliminary Plat application, <br />2. Deliberate on the proposal, and <br />3. Recommend approval of the proposal, with the following suggested conditions: <br />a. The developer shall submit and record a Road Maintenance Agreement (RMA) <br />and a Disclosure Statement with the final plat. These documents shall <br />acknowledge and assign perpetual maintenance responsibility for the private <br />roads to the Homeowners Association. It shall also acknowledge that any future <br />effort to convert these roads from private to public would require significant <br />design changes, construction costs and additional permitting with Orange <br />County, NCDOT, USACE and NCDEQ. <br />b. The developer shall evidence that sufficient access to off-site water and fire <br />suppression devices have been obtained to the satisfaction of the Orange <br />County Fire Marshall. <br /> 131
