Article 1: Administration <br /> Section 1.3: Board of County Commissioners <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 1-9 <br /> <br />(K) In areas between official cross sections, the Special Flood Hazard Overlay District shall <br />be determined by scaling the distances on Flood Insurance Study maps; and <br />(L) The regulatory flood protection elevation must in all cases be the controlling factor in <br />locating the outer limits of the Special Flood Hazard Area Overlay District.4 <br />SECTION 1.3: BOARD OF COUNTY COMMISSIONERS <br />1.3.1 Responsibilities <br />The Orange County Board of Commissioners shall have the following responsibilities in relation to <br />the administration of this Ordinance: <br />(A) Hear and decide applications for amendments to the text, schedules, and map portions of <br />this Ordinance, which shall be processed in accordance with the provisions detailed <br />herein. In exercising this power, the Board is bound by the State enabling legislation, the <br />terms of this Ordinance, and applicable court decisions in carrying out its legislative <br />function. <br />(B) Hear and decide applications for the approval of Class A Special Use permit as noted in <br />the Schedule of Permitted Uses as requiring approval of the Board of Commissioners, <br />which shall be processed in accordance with the provisions detailed herein. In exercising <br />this power, the Board is bound by the State enabling legislation, the terms of this <br />Ordinance, and applicable court decisions in carrying out its decision making function <br />within a quasi-judicial capacity and shall make its decisions based on substantial <br />evidence contained in its record of proceedings and shall be bound by the general and <br />specific standards and requirements of the particular Special Use as defined herein. <br />(C) Hear and decide applications appealing those decisions appealed to the Board of County <br />Commissioners. <br />(D) Establish Rules of Procedure for the conduct of hearings and other proceedings before <br />the Board of County Commissioners in exercising responsibilities identified herein. <br />(E) Make the necessary appointments to the Planning Board and Board of Adjustment. <br />(F) Provide, by appropriation, funds for the administration of this Ordinance. <br />SECTION 1.4: PLANNING DIRECTOR <br />1.4.1 Responsibilities <br />(A) The Planning Director, or his/her designee, shall have the responsibility for the <br />administration, interpretation, and enforcement of this Ordinance. <br />(B) Within this Ordinance, ‘Planning Director’ is synonymous with the individual actually <br />serving in that capacity or a designated employee unless otherwise specified. <br />(C) The Planning Director is an employee of the County hired by and reporting to the County <br />Manager and shall have the following duties in respect to this Ordinance: <br />(1) Administering all provisions of this Ordinance for which administrative <br />responsibilities are not otherwise expressly assigned; <br />(2) Making interpretations of the provisions of this Ordinance; <br />(3) Reviewing all applications submitted in accordance with the requirements of this <br />Ordinance to ensure compliance with the provisions of this Ordinance; <br />(4) Coordinating County staff’s compliance with duties and responsibilities specified <br />in this Ordinance; <br /> <br />4 As we are eliminating the Special Flood Hazard Area Overlay District, these provisions are no longer necessary. <br /> 92
