<br />3. Residential development within District 3 shall be limited to age restricted <br />housing for individuals 55 years and older. <br />4. County staff shall prepare a ‘Declaration of Development Restrictions and <br />Requirements’ outlining all conditions and development limitations associated <br />with the Project that the Applicant shall record within the Orange County <br />Registrar of Deeds office within 180 days of approval. <br />5. In accordance with the submitted Application, development of the Project shall be <br />limited as follows: <br />a. ENVIRONMENTAL FACTORS: The project shall abide by the <br />performance standards as articulated in Section 6.4 of the UDO inclusive. <br />b. RATIO STANDARDS: <br />i. Minimum Percentage of Open Space for project: 30% or 81.6 <br />acres. <br />ii. Maximum Allowable Floor Area Ratio for District 1 and 2 shall be as <br />follows: <br />1. District 1: 0.20 or 1,248,000 sq.ft. <br />2. District 2: 0.13 or 261,800 sq.ft. <br />iii. District 3 shall have an allowable density of 10 dwelling units per <br />acre with a maximum of 760 total residential units on 76 acres of <br />land area. <br />c. UTILITIES: <br />i. Approval of the Setters Point MPD-CZ application does not <br />constitute a guarantee utility services shall be provided and/or <br />extended to serve the project. <br />ii. Development(s) within the project shall only be served by public <br />water and sewer services as provided and maintained by the Town <br />of Hillsborough. <br />iii. Utilities shall not be extended to serve District(s) 2 or 3 until the <br />inter-local utility agreement between Orange County and the Town <br />of Hillsborough is amended authorizing same. The applicant <br />assumes responsibility for submitting a formal request to amend the <br />aforementioned agreement allowing for the extension of services. <br />Further no applications shall be accepted for development in <br />District 3 until additional efforts have been successfully made to <br />revise the Urban Services Boundary Line to align with the <br />southernmost extents of the proposed master plan. <br />iv. A written, signed agreement between the applicant and the Orange <br />County and/or the Town of Hillsborough shall be executed, which <br />describes the timing, phasing, design, and financing of public water <br />distribution and public sanitary sewer collection mains for the <br />project. <br />v. Connection to public water and sewer shall comply with applicable <br />Town of Hillsborough standards.
