6. The applicant has proposed to allow for the development of a School elementary, <br />secondary, and high school land use as a permitted use of property within the project. <br />Section 5.2.2 Table of Permitted Uses Economic Development Districts would allow for a <br />School elementary, secondary, and high school land use to be developed within: <br />a. Economic Development Buckhorn Low and High Intensity (EDB-1 and EDB-2) with <br />the review and approval of Class A Special Use Permit, and <br />b. Economic Development Eno Low Intensity (EDE-1) as a permitted use (i.e. subject <br />to staff review and approval of a site plan application only). <br />Currently a School elementary, secondary, and high school land uses are not a permitted <br />within the various Economic Development Hillsborough general use zoning districts (i.e. <br />EDH-1, EDH-2, EDH-3, EDH-4, and EDH-5). <br />While there is concern about allowing the aforementioned land use within this area, staff <br />recommends a condition be imposed indicating that such a development shall abide by <br />the development standards detailed within Section 5.8.4 of the UDO and obtain approval <br />of a Class A Special Use Permit application prior to the commencement of earth <br />disturbing activity. <br /> <br />Neighborhood Information Meeting: A neighborhood information meeting for the project was <br />held on September 14, 2017 in accordance with Section 2.9.2 (D) of the UDO. A synopsis of <br />concerns can be found within Attachment 5. <br /> <br />Notification Requirements: Per Sections 2.9.2 of the UDO, staff has caused a notice of this <br />hearing to be published: ‘as least twice in a newspaper of public circulation in the County’ for <br />two (2) successive weeks: ‘ no less than ten (10) days nor more than twenty-five (25) days’ <br />before the public hearing. The legal ad was published accordingly. <br /> <br />On September 18, 2017 staff sent written notice by certified mail to all adjacent property owners <br />located within 500 feet of the subject property as required by Section 2.8.7 of the UDO. On <br />September 22, 2017 staff posted a sign(s) on the properties subject to the application providing <br />notice of the date, time, and location of the Planning Board meeting. Attachment 8 contains the <br />Notification and Certification of mailing. <br /> <br />Planning Director’s Recommendation: The Planning Director recommends approval of the: <br />1. Statement of Consistency indicating the zoning atlas amendment(s) are reasonable <br />and in the public interest as contained in Attachment 6, <br />STAFF COMMENT: This presumes the land use designation of the <br />property contained within District 3 is changed from Rural Residential to <br />Economic Development Transition Activity Node as detailed herein. <br />This will allow the project to proceed as a MPD-CZ project. <br />If the aforementioned FLUM is not approved, our recommendation will have <br />to be modified accordingly. <br />2. Ordinance amending the Zoning Atlas, as well as imposing development conditions, <br />for the identified parcels as contained in Attachment 7. <br /> <br /> 258
