STAFF COMMENT: As a general reminder per Section 4.7.2 of the UDO, <br />the MTC Overlay District extends along all Interstate Highways within the <br />County. In those instances where there is an interchange, the District <br />extends 2,500 ft. on each side of the intersecting roadway. <br />In this specific instance the MTC Overlay District extends along Old NC <br />Highway 86 from the Interstate 40 interchange for 2,500.ft (approximately <br />half a mile). <br />Staff is supportive the proposed condition(s), which will require re- <br />establishment of cleared vegetation along identified roadways. <br /> <br />Solid Waste: The applicant has indicated development within the project shall abide by the <br />Orange County Solid Waste Management Ordinance. <br /> <br />Analysis: As required under Section 2.9.2 (E) of the UDO, the Planning Director is required to: <br />‘cause an analysis to be made of the application’ and pass that analysis on to the reviewing <br />body. In analyzing this request, the Planning Director offers the following: <br />1. The application has been deemed complete in accordance with the submittal <br />requirements of Section 2.9.2 (C) of the UDO. <br />2. The proposal appears consistent with the various goals outlined within the <br />Comprehensive Plan concerning development, including: <br />a. Land Use Overarching Goal: Coordination of the amount, location, pattern, and <br />designation of future land uses, with availability of County services and facilities <br />sufficient to meet the needs of Orange County’s population and economy <br />consistent with other Comprehensive Plan element goals and objectives. <br />b. Land Use Goal 2: Land uses that are appropriate to on-site environmental <br />conditions and features and that protect natural resources, cultural resources, and <br />community character. <br />c. Land Use Goal 3: A variety of land uses that are coordinated within a program <br />and pattern that limits sprawl, preserves community and rural character, minimizes <br />land use conflicts, supported by an efficient and balanced transportation system. <br />3. The applicant has provided a basic environmental assessment as part of this submittal. <br />Staff has reviewed and determined there ought to be no significant environmental impact <br />from this project based on existing conditions. <br />Staff is recommending the imposition of a condition as part of the approval of this project <br />that a formal environmental impact statement (EIS) be prepared for all site plan <br />submittals as detailed in Section 6.16 of the UDO. <br />4. Within District 3 the applicant is proposing a density of approximately 10 units per acre. <br />Current zoning would only allow 1 dwelling unit per acre. <br />Please note the recommended FLUM category for the properties comprising District 3, as <br />well as the general use zoning designation of same, do not support the development of <br />the proposed residential land uses. <br />5. Staff has determined that the proposed development is consistent with existing and <br />anticipated development within the area and the various land uses associated with the <br />project are compatible. <br /> 257
