Article 5: Uses <br /> Section 5.12: Standards for Extractive Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-128 <br /> <br />In addition to the information required in section 2.7, the following shall be <br />supplied as part of the application: <br />(a) A copy of the application filed with the North Carolina Department of <br />Health and Human Services for a hazardous waste management facility. <br />(b) A detailed description of the type facility planned. Included in this <br />description will be the size of the project, size of the site, the type storage <br />involved, and the method of permanent disposal anticipated. <br />(c) Letters from the appropriate agencies that the facility has adequate <br />protection against fire, vandalism and personal injury. <br />(d) Survey of floodplain and floodway location on the site plan. <br />(e) An emergency management plan that has been submitted to the <br />appropriate North Carolina State agency, and approved. <br />(2) Standards of Evaluation <br />(a) All necessary State permits have been applied for and granted to the <br />applicant. <br />(b) The description of the type facility planned, including a detailed <br />description of the type wastes to be stored or disposed of on the site, the <br />size of the finished project, method of storage or final disposal. <br />(c) Adequate fire, police and rescue protection can be provided. The <br />appropriate agencies have written letters confirming adequate protection. <br />(d) The site is of adequate size to provide a buffer for adjacent properties. <br />The buffer shall also be of sufficient size to prevent adverse effects in <br />adjacent property. <br />(e) Access to the site is directly from an interstate, arterial, or major collector <br />street. <br />(f) Accident prevention/emergency management plan approved by the <br />State. <br />(g) Location of flood plain if any is on site. <br />(h) The site plan has buffer from streams. <br />SECTION 5.12: STANDARDS FOR EXTRACTIVE USES <br />5.12.1 Borrow Pits for Federal and State Highway Projects <br />(A) General Standards <br />(1) The borrow pit is located within one-half mile of the construction site; <br />(2) An Erosion Control Plan has been approved by the Department of Environment, <br />Health and Natural Resources; <br />(3) The material extracted is to be used solely for a State or Federal road <br />construction project; and <br />(4) Road construction plans include provision for reclaiming the excavated area. If <br />the reclamation plan involves filling the excavated area, the fill material must be <br />inert material defined as beneficial fill by the Solid Waste Branch of the <br />Department of Environment and Natural Resources, provided that the debris is <br />also associated with a State or Federal Highway road construction project. <br />Inclusion of reusable or recyclable materials in the reclamation or filling of the <br />borrow pit should be minimized. A proposed debris recycling program or a <br />statement as to why material will not be recycled must be submitted for review by <br />Orange County. <br /> 230
