Article 5: Uses <br /> Section 5.8: Standards for Adult and Child care & Educational Facilities <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-83 <br /> <br />after 7 p.m. if an existing residence is located within 1,000 feet of the facility, <br />unless approved otherwise in the permit. <br />(7) All unpaved areas shall be maintained in a manner which prevents dust from <br />adversely impacting adjacent properties. <br />5.7.8 Theater27 <br />(A) Standards for the NC-2, CC-3, EDH-1, EDH-2, and EDH-3 Zoning Districts <br />(1) All theater activites shall be located indoors. No outside performances shall be <br />permitted. <br />(B) Standards for the GC-4, EDB-2, EDE-2, and EDH-4 <br />(1) Outdoor performance areas shall abide by the following standards:28 <br />(a) A 50 foot setback from all property lines. <br />(b) A Type B Land Use Buffer, as detailed in Section 6.8.6 of this Ordinance, <br />shall be installed around the perimeter of the outdoor performance area. <br />(c) If the property is adjacent to a residential land use or general use zoning <br />district, performances shall abide by the following hours of operation: <br />(i) Sunday through Thursay – performances shall cease at 9:00 <br />p.m. <br />(ii) Friday through Saturday – performances shall cease at 11:00 <br />p.m. <br />Recreational Uses Uses Not Listed <br /> Submittal Requirements <br /> In addition to the information required under Section 2.7of this Ordinance, the <br />following shall be submitted as part of the application: <br /> Detailed narrative detailing how proposed use is consistent with the <br />definition of Recreational Land Use as detailed in Article 10 of this <br />Ordinance. <br /> Evidence applicable minimum local, State, or Federal licensing <br />requirements have been satisfied. <br /> Standards of Evaluation. <br /> Facility, including any outdoor activity areas, shall be setback a minimum of 100 <br />feet from all property lines. <br /> A Type D land use buffer, as detailed in Section 6.8.6 of thie Ordinance, shall be <br />installed/maintained along all property lines. <br /> <br /> <br />27 By definition the term ‘theater’ now includes movies, plays, concerts, etc. <br />28 Staff is proposing establishing minimum design standards for outdoor performances to address potential <br />impacts to adjacent properties. <br /> 218
